경찰 수사의 독립성과 책임성 확보를 위한 검·경 수사권 조정의 향후 입법과제 (Future Legislative Task on Adjustment of Investigative Rights between Prosecution and Police to secure the independence and accountability of police investigations)

초록

최근 2023년 3월 23일 ‘검사의 수사권 축소 등에 관한 권한쟁의 사건’의 결정에서 ‘헌법이 수사권을 행정부 내의 특정 국가기관에 독점적·배타적으로 부여한 것이 아님’을 판시하고 있다(2022헌라4). 이는 ‘대통령을 수반으로 하는 행정부’ 내에서 수사권을 어느 기관에 조정·배분할지는 입법절차를 통해 결정할 사항으로, 이로써 수사권이 분산되어 검사나 경찰, 자치경찰 등이 수사를 하게 되어, 상호견제 및 협력이 중요한 의미를 가지게 된다. 이에 본고는 검·경 수사권을 조정하고 검·경 관계를 수사지휘관계에서 상호협력관계로 전환하여 경찰 수사의 독립성 보장과 책임성을 강화한 검·경 수사권 조정 입법내용(개정 형사소송법 등의 내용)을 검토 및 분석하고, 그 입법내용의 한계와 문제점을 지적하여 향후 검·경 상호간의 바람직한 상호견제 및 협력 그리고 완전한 수사권, 기소권 분리 체계를 위한 개선방안을 수사단계별로 검토하였으며, 이 검토 과정에서 2021년 1월 1일부터 시행된 대통령령인 수사준칙규정과 검사수사범위규정도 분석 및 평가하였다. 그리고 경찰 수사의 독립성과 책임성 확보를 위한 검·경 수사권 조정의 향후 입법과제를 제시하였다.

영어초록

Recently the ruling of 'Jurisdiction Conflict Case on Reduction of Prosecutor's Investigative Rights' on March 23, 2023, ruled 'Constitution does not grant the investigative rights exclusively to a specific national agency(2022 Heonra 4). This is the matter to be decided in the legislative procedure that the investigative rights would be granted to which agency in the Administration headed by President', and through which as decentralized the investigative rights, the prosecutor, or policy, local policy, etc. can start the investigation, the mutual check and cooperation have major implication. Therefore, this paper analyzed the legislation of adjustment of investigative rights between the prosecution and the police (Amended Criminal Procedure Code), which adjusts the investigative rights between the prosecution and the police and switches the relationship between prosecution and the policy from the relationship to direct the investigation to ‘Mutual Cooperative Relationship’, reinforcing the independency and responsibility of police investigations, reviewed desirable mutual check and cooperation and improvement measures between the prosecution and the police by investigation stage pointing out the limits of legislation, and analyzed and assessed Criminal Investigation Rules and Rules on Prosecutor Criminal Investigation Scope, which are Presidential Decrees implemented from January 01, 2021. And finally, the future legislation tasks of adjustment of investigative rights between the prosecution and the police to complete the secure the independence and accountability of police investigations are suggested.
