검·경 수사권 조정안에 따른 수사절차에 있어서 인권보장 방안 (Strengthening Protection of Human Rights in Investigative’s Proceedings in Post-adjustment of Investigative Powers between the Prosecutions and the Police)

초록

현재 이루어지고 있는 수사권조정논의는 이러한 국민들의 수사절차에 대한 불신을 해소하는데에 초점을 맞추어야 한다. 그러기 위해서는 수사기관 상호간 견제와 균형이 가능하도록 하여 권한의 남용을 막아야 할 것이다. 1차적 수사권을 경찰의 권한으로 하는 신속처리안건의 내용은 견제와 균형면에서 방향성은 맞다. 그럼에도 경찰에게 수사종결권을 부여하는데 대하여 일부 우려의 목소리가 있는 것도 현실이다.
이러한 비판과 일부의 우려는 첫째, 불송치결정한 사건기록을 검찰에 송부하면 검찰이 검토 후, 직접수사가 가능하도록 하면 해소될 것이다. 불송치한 사건에 대한 검토 후, 검찰의 직접수사가 가능하도록 하는 것은 경찰의 객관적이고 공정한 수사가 이루어지게 만드는 외부적 요인이 될 수 있으며, 이러한 방안은 경찰의 수사에 대한 검찰의 사후통제를 통하여 국민의 인권침해소지를 충분히 줄일 수 있게 된다는 점에서 긍정적인 면이 있다. 반면에 향후 경찰의 공정하고 객관적인 수사능력에 대한 국민들의 공감이 전제된다면 경찰에게도 독립된 수사기관으로서 독자적인 수사권을 행사할 수 있도록 영장청구권을 가지도록 하는 방안을 생각해볼 수 있다. 영장청구에 대하여는 법원이 심사하여 발부하기에 헌법개정절차를 거쳐야 하지만 경찰에게 영장청구권을 부여하는 것은 경찰에 의한 인권침해소지도 없을 뿐더러 경찰의 수사역량을 제고할 수 있다.
둘째, 경찰 수사권의 적정한 행사를 심사할 수 있는 외부 시민감시·통제기구를 설립하여 수사권 남용으로 인한 인권침해 소지를 줄이는 것이다. 오늘날 민주국가에서 주권은 국민에게 있고 모든 권력은 국민에게서 나오는 것이다. 따라서 경찰의 입장에서 주인인 국민으로 구성된 외부 시민감시·통제기구의 직접통제를 받아들이는 것은 자연스러운 일이다.
경찰수사에 비하여 검찰수사에 대한 통제제도는 거의 마련되어 있지 않다. 검찰의 불공정한 수사나 공소제기권의 남용에 의한 인권침해를 막기가 어렵다. 향후 국회의 논의에서 검찰권 남용의 통제방안에 대하여 각고의 고민을 해야 할 것이다.

영어초록

The ongoing debate on modifying the investigative power should focus on addressing public distrust in the investigation process. To do so, the authorities should prevent the abuse of the power by allowing checks and balances between the investigative agencies. The contents of the "prompt-handling agenda," which gives the police the primary investigative power, are well-directed in terms of checks and balances. Nonetheless, it is also true that there are some concerns about giving the police the right to close investigations.
Such concerns and criticism will be resolved, first, by allowing the prosecution to conduct their own investigations after reviewing records of cases, which the police have decided not to send to the prosecution. And such measures may reduce the possibility of human rights violations against the public through sufficient post-control of the prosecution against the police investigations.
On the other hand, the police should be allowed to exercise their independent investigative power as an independent investigative agency. In regards to the request for issuing a warrant, it requires to go through a constitutional amendment process because the court reviews it and issues a warrant, but granting the police the right to request a warrant would not only eliminate the possibility of human rights violations by the police, but also enhance the police's capability to investigate.
Second, establishing an external civic monitoring and control body that can examine proper exercise of the police’s investigative power can reduce the possibility of human rights violations caused by the abuse of the investigative power. In today’s democratic societies, sovereignty resides with the people and all power comes from the people. Therefore, it is natural for the police to accept direct control of an external civic monitoring and control body composed of its owner, the people.
There is little control over the prosecution's investigation power compared to that of the police. So it is difficult to prevent human rights violations by the prosecution's unfair investigation or the abuse of the power to file an indictment. In future discussions at the National Assembly, deliberation on how to control the abuse of the prosecution power will be needed.
