검ㆍ경수사권조정과 경찰의 개혁과제 (A Study on the Adjustment of Investigative Rights between the Police and the Prosecution and the Police’s Reform Tasks)

초록

이 논문은 2018년 6월 정부가 발표한 「검ㆍ경수사권조정합의문」의 수사권조정 관련 주요내용을 검토ㆍ평가하여 향후 수사권조정과 함께 경찰이 독자적인 수사기관으로서 실천해야 하는 개혁과제를 제시하는 데 그 목적이 있다.
이를 위하여 우선 수사권조정의 의미와 역사, 수사권조정 논쟁 등 수사권조정에 관한 기본적 이론을 서술함으로써 본 논제의 대상과 범위를 명확히 하였으며, 이어서 정부의 검ㆍ경수사권조정합문의 주요내용 중 수사권조정 관련 항목들을 검토ㆍ평가하였다.
다음으로 앞의 검ㆍ경수사권조정합의문에 대한 평가를 토대로 하여 수사권조정 이후 경찰이 독립적 수사기관으로서 국민들로부터 신뢰와 지지를 받기 위해 검ㆍ경수사권조정과 동시에 수행해야 하는 개혁과제를 경찰권력의 남용에 대한 통제강화, 경찰수사의 공정성확보, 경찰수사의 전문성 제고, 경찰수사에서의 인권보호 등 4개 항목으로 구분하여 구체적으로 제시하였다.

영어초록

The purpose of this study is to present reform tasks for the police to carry out as an independent investigative authority, along with the adjustment of investigative rights, by examining and assessing major content related to the adjustment of investigative rights in the Agreement on the Adjustment of Investigative Rights between the Police and the Prosecution released by the Korean government in June 2018.
To this end, the subject and scope of this study were clarified by explaining basic theories about the adjustment of investigative rights, including its meaning and history, and related disputes. Next, this study examined and assessed matters related to the adjustment of investigative rights from the Agreement on the Adjustment of Investigative Rights between the Police and the Prosecution, released by the government. Based on the assessment of the aforementioned agreement, this study presented four reform tasks for the police to carry out, along with the adjustment of investigative rights, in order to win the public's trust or its backing as an independent investigative authority after the adjustment. The four reform tasks include strengthening the control over the abuse of police authority, securing the impartiality of police investigation, improving the professionalism of police investigation, and protecting human rights in police investigation.
