스포츠 조직의 자치구조 확립과 굿거버넌스 -스포츠기본법 이후 대한체육회의 나아갈 방향과 관련하여- (Establishment of Autonomy Structure of Sport Organizations and Good Governance)

초록

2021.8.10.에 제정된 스포츠기본법 제2조(기본이념)가 규정하는 바, “스포츠의 다양성, 자율성과 민주성의 원리가 조화롭게 실현되도록 하는 것”을 기본이념의 하나로 삼고 있다. 이는 스포츠에 있어서 굿 거버넌스의 구현을 의미하는 것으로도 이해된다.
스포츠에 내재하는 본질적 가치로서의 자율성과 그 실천원리로서의 스포츠 자치는 스포츠의 발전과 선진화에 불가결한 요소이다. IOC는 자율성을 올림픽 운동과 스포츠 활동의 필수요건이라고 표현하면서, 이를 통해 스포츠 가치의 수호, 경쟁의 순수성(integrity), 봉사자 동기부여와 참여, 청년교육, 여성·남성·아동 등 모든 이들의 복지향상, 그리고 종국적으로는 스포츠의 신뢰성과 정당성에 기여할 수 있다고 한다.
그리고 선진국의 스포츠에 있어서 굿 거버넌스가 주목받는 것은 그것이 스포츠조직의 자율성 보장, 스포츠 자치 확장의 전제가 되기 때문이다.
스포츠자치는 결사의 자유와 단체의 사적자치에 법적 근거를 갖고 있다. 헌법은 제21조 제1항에서 모든 국민에게 집회·결사의 자유를 보장하고 있고, 결사의 자유의 구체적 실현방법으로 스포츠단체가 사적자치의 틀 안에서 그 조직의 설립이나 구성, 운영 및 경기규칙 등 자율적으로 단체의 자체적인 규칙을 정할 수 있다. 이러한 스포츠규칙은 설령 정치(精緻)하지 못한 경우라 하더라도 하나의 영향력 있는 사적 규범(私的 規範)으로 작용하게 되고, 이는 자기결정권행사의 결과로 만들어진 것으로서 국가의 간섭으로부터 벗어나 있는 것이 원칙이다. IOC 헌장의 역사가 보여주듯이 정부권력 및 경제적 압력으로부터 자율성을 확보하는 스포츠 환경을 만들어가야 한다. 여러 스포츠 선진국가에서 거버넌스 코드 내지 에티켓 코드를 만들어 스포츠 조직의 인테그리티 및 자율성을 확보하고 굿 거버넌스 확립을 위한 노력을 경주하고 있다. 우리도 글로벌 스탠다드에 부합하는 굿 거버넌스 코드의 시행이 필요하다. 그리고 체육의 이름을 사용하고 있는 많은 단체의 명칭을 자율성의 의미가 드러나도록 스포츠가 들어가는 이름으로 바꾸는 노력도 필요하다.

영어초록

Article 2 (Basic Philosophy) of the Basic Act on Sport of Korea enacted on August 10, 2021, has the expression ‘to ensure that the principles of diversity, autonomy, and democracy in sport are harmoniously achieved’. It is also understood to mean the implementation of good governance in sport. Autonomy as an intrinsic value inherent in sport and sports autonomy as a practical principle is indispensable for the development and advancement of sport. The IOC today describes autonomy as a necessity for the Olympic and sports movement, since autonomy guarantees the preservation of the values of sport, the integrity of competitions, the motivation and participation of volunteers, the education of young people, and their contribution to the well-being of all women, men, and children, thereby contributing to its credibility and legitimacy. According to the IOC, only an autonomous movement, namely one that is self-regulated and self-managed without any interference, can guarantee ‘a philosophy of life, harmoniously improving the qualities of body, will and mind’ (Fundamental Principles of Olympism).
And good governance is attracting attention in sports in developed countries because it is a premise for securing the autonomy of sports organizations and expanding sports autonomy. Sports autonomy has a legal basis for freedom of association and private autonomy of organizations. The Korean Constitution guarantees freedom of assembly and association for all citizens in Article 21, Paragraph 1, and as a specific way to accomplish the freedom of association, sports organizations can autonomously establish, organize, and operate within the framework of private autonomy. Even if these sports rules are not sophisticated, they act as an influential private norm, and since this was made as a result of the exercise of the right to self-determination, it is free from the interference of the state. As the history of the IOC Charter shows, a sports environment that secures autonomy from government power and economic pressure needs to be created. Several advanced sports countries have created governance codes or etiquette codes to secure the integrity and autonomy of sports organizations and to establish good governance. We also need to implement good governance codes that comply with global standards. In addition, it is also necessary to change the names of many organizations using ‘physical education’ to ‘sport’ which reveals the meaning of autonomy.
