초록

사법행정의 거버넌스 모델은 이념형적으로 법원형, 행정부형, 독립기구형(협치형)으로 구분할 수 있다. 전근대 구체제 시대 유럽의 사법행정은 법원형에 가까운 것이었지만, 근대국가가 성립하면서 행정부형으로 전환되어 오랫동안 유지되었다. 그러나 독재체제를 겪으면서 행정부형의 사법독립 침해 위험성을 인식한 유럽 나라들은 사법행정권을 행정부에서 몰수하여 제3의 독립기구에게 맡기기 시작했고 이러한 경향은 최근 전 세계로 확산되고 있다.
일제강점기 한국의 사법행정은 행정부형이었으나, 해방 후 식민체제에 대한 반동과 법관들의 권력욕이 결합하여 법원형으로 전환되었다. 더욱이 군부독재체제를 거치면서 대법원장 일인지배체제와 법관들의 행정직 겸직을 특징으로 하는 과잉의 기형적인 법원형으로 변질되었다. 이러한 법관에 의한 사법행정의 식민지화는 정치적 민주화 이후에도 계속 강화되어 결과적으로 법원 내부적인 사법독립 침해의 위험성을 증가시켰다.
이제 한국은 서구와는 달리 행정부가 아니라 법원으로부터 사법행정을 독립시켜야 한다는 요청에 직면하고 있다. 현행헌법은 사법행정에 관하여 침묵하고 있으므로 굳이 개헌을 통하지 않더라도 현재 법원행정처가 수행하고 있는 사법행정을 법원에서 떼어내 독립기구에게 맡길 수 있으며, 그러더라도 위헌이라 할 수는 없을 것이다. 무엇보다 사법행정은 본질적으로 사법작용이 아니라 행정작용인 것이다.

영어초록

Governance of judicial administration can be classified as court model, executive model, and independent organization model, the last one being also known as partnership model. Judicial administration in pre-modern ancien regime was managed on the basis of court model, which the people’s revolution eventually overthrew and was followed by executive model in modern state. After the experience of dictatorship, however, many European countries now cognizant of danger of infringement by the executive on judicial independence have substituted independent organization model with executive model. This trend toward the third way of judicial administration is now rapidly expanding beyond Europe to all over the world.
Judicial administration in Korea under Japanese colonialism was governed by the executive like other Western countries at that time. After the Independence, Korea adopted court model of judicial administration as a reaction to the colonialism and as a result of judges’ desire to seek power. During the military dictatorship in the 1960s and 1970s, moreover, Korean judicial administration gradually became to be exercised on an excessive and distorted court model, the peculiarity being one-man rule of Chief Justice and concurrent office held by judges of both adjudication post and administration post. This trend of judges’ colonization of judicial administration has strengthened even after the democratization of Korean society, producing increased danger of court-internal infringement on judicial independence.
Koreans are now faced with the task of rebuilding judicial administration independent from the court as well as from the executive. Admittedly, Korean Constitution does not seem to prevent them from depriving judges of judicial administration power and recasting it on the basis of independent organization model, or partnership model. Above all, judicial administration in its nature is the administrative rather than the adjudicative.
