글로벌 디지털 표준협력과 데이터 거버넌스: 자유주의적 인권과 개발협력 담론을 중심으로 (Global Digital Standards Cooperation and Data Governance: Human Rights and Development in the Digital Age)

초록

제4차 산업혁명시대에 접어들며 데이터를 원유로 삼아 새로운 가치사슬을 순환시키는 디지털시대에 접어들고 있다. 5G 혁명으로 데이터 처리 및 저장 비용이 감소함에 따라 국제 사회는빅데이터 분석 등 디지털 협력을 통해 개도국의 발전 문제에 접근할 수 있게 되었다. 코로나19의 확산이 산업 전반에 걸친 디지털화를 앞당기고 있지만 디지털 표준의 제정과 감독은 수백 개의 표준개발기구와 컨소시엄으로 파편화되어 있어 협력의 비용을 높인다. 데이터의 자유로운 흐름, 즉 상호운용성(interoperability)를 둘러싼 상이한 시각과 의견 차이는 글로벌 디지털 협력을 더욱 어렵게 만든다. 미국은 데이터의 자유로운 흐름과 투명한 사용을 보장하는글로벌 표준의 제정을 주장하고 있는 반면에 중국과 유럽은 개인정보보호와 ‘데이터 주권'을내세워 자국 내 데이터 보호를 위한 법안을 제정하고 있다. 특히 중국은 개도국 원조에 있어서도 ‘내정불간섭’과 개도국이 선진국을 뛰어넘는 우회추월전략(leapfrogging strategy)을 내세워 거버넌스에서의 담론을 주도하려 하고 있다. 이 논문은 디지털 표준과 담론의 협력을 주도할 거버넌스가 부재한 상황에서 데이터 표준협력의 주요 쟁점 중의 하나인 데이터 이동(상호운용성)과 개발협력에서의 자유주의적 인권의 문제를 이념, 행위자 중심의 담론, 그리고 제도를 바탕으로 살펴보려 한다.

영어초록

In the era of the Fourth Industrial Revolution, data is now used as crude oil driving the circulation of new value chains. As data processing and storage costs have decreased due to the 5G revolution, the international community has been able to address the development problems facing developing countries through digital cooperation such as big data analysis.
Although the spread of COVID-19 is accelerating digitalization across industries, the establishment and supervision of digital standards is fragmented into hundreds of standards development organizations and consortia , increasing the costs of cooperation. The different perspectives and disagreements surrounding the free flow of data (interoperability), make global digital collaboration even more difficult. The US is advocating for the establishment of a global standard that guarantees the free flow and transparent use of data, while China and Europe are enacting legislation to protect data in their own countries in the name of privacy and “data sovereignty.” China is trying to lead the discourse in global governance by advocating “non-interference in internal affairs” as a principle in providing aid to developing countries, while developing a leapfrogging strategy to surpass developed countries. In the absence of governance to lead cooperation in setting and enforcing digital standards and to guide relevant discourse in the wake of rapid technological advancement and innovation, this paper addresses the issues of data transfer (interoperability) and human rights, which are some of the main issues of data standards cooperation. This article will examine these issues from the perspective of ideas, actors and their discourse, and institutions.
