초록

이 글에서는 DAO가 무엇인지부터 시작해서 DAO의 장점과 단점, 법적 과제, 그리고 DAO의 몇 가지 예를 설명했다. 인간의 개입 없이 기능하는 탈중앙화 자율조직은 공상과학 소설에서나 나올 법한 것처럼 보일 수 있지만, 블록체인 기반 DAO는 비트코인이 탄생한 이래로 현실이 되었다. DAO는 Decentralized Autonomous Organization의 약자로 ‘Dao’로 발음된다. 한국어로는 ‘탈중앙화 자율조직’으로 번역하며, 영어로 ‘DAO’라고 쓰는 것은 드물지 않다. 분산화된 자율조직이라고 쓰는 경우도 있으나 말 그대로 DAO는 탈중앙화되고 자율적으로 기능하는 조직이다. DAO는 블록체인의 응용분야 중 하나이다. 비트코인의 발자취를 따라 많은 암호화폐 프로젝트, 서비스 및 플랫폼이 DAO로 등장했다. 또한 자동화, 원격근무 등 기업과 업무 스타일이 급격히 변화함에 따라 일부 기업은 Consensys 만큼 급진적이지는 않더라도 DAO/DAC가 될 것이다.
종래의 조직에서는 중앙에서 의사결정을 하는 이사회 같은 조직이나 대표이사 혹은 사장과 같은 사람이 있고, 그 결정에 따라 조직이 움직였다. 반면, DAO에서는 중앙조직 대신 규칙이 존재한다. 사람들의 활동은 이러한 규칙에 따라 수행되며 중앙조직 없이 자동화된 작업을 수행할 수 있다. 그러나 자동화되어 있지만 의사결정, 구현 및 사용에 인간의 개입이 포함되며 규칙기반 심의활동도 수행된다. 블록체인 기반 DAO 구현은 이러한 규칙을 프로그램으로 설명하며, 이는 종종 오픈 소스 스마트 계약으로 구현되고 커뮤니티에서 유지 관리된다.
ICO를 통해 자금을 조달하고, 자금을 관리하고, 투명하고 공정한 서비스를 제공하기 위해 스마트 계약을 기반으로 다양한 기업과 프로젝트가 분산되고 자율적으로 기능하는 미래가 멀지 않을 수 있다. 자본주의 사회의 문제점으로 지적되어 온 자본집중의 불균형과 자본가와 노동자의 틀은 DAO에는 존재하지 않는다. 조직의 창립자라고 해도 기본적으로 다른 참가자와 마찬가지로 토큰 보유자 중 한 명일뿐이며 회사의 관리자, 정규직 직원 및 계약직 직원 간의 구분은 없다.
탈중앙화 사회가 실현되면 같은 생각과 희망을 가진 사람들이 위치나 지위에 관계없이 모일 수 있게 될 것이다. 다양한 사람들이 모일수록 더 많은 정보와 지식이 축적되어 선순환이 이루어지고 이는 조직의 발전으로 이어지게 된다. 그 결과 사람들이 계속 발전하는 조직에 모일 것이고, NFT나 DAO와 같은 새로운 형태의 자금조달이 가능해질 것이다.
DAO를 시작하려면 Blockchain 기술의 특성을 정확히 이해해야 한다. 향후 DAO를 시작하고자 하는 조직 운영자는 충분한 학습을 해야 할 것이다. 정부에서도 창업 초창기부터 진행해 온 블록체인 비즈니스의 지식과 개발 노하우를 바탕으로 자율적으로 프로젝트를 추진하는 조직의 출범을 지원해야 한다. 이러한 정책지원은 DAO 프로젝트 운영에 없어서는 안 될 필수 요소이다. 또한 많은 DAO 운영에서 사용하는 Discord의 출시를 지원해야 한다.
DAO에는 많은 장점이 있지만 몇 가지 단점(과제)도 있다. 예를 들어, 다음 몇 가지가 주요 항목이다. 우선 조직으로서의 느린 의사결정이 장애물이다. 또한 입법이 뒤처지고 있다. 또한 DAO 스마트 계약은 전 세계적으로 분산된 노드에서 실행되므로 국가 및 지역마다 다른 법률로 인해 ‘법의 충돌’ 문제가 발생할 수 있다. 비트코인과 같은 암호화폐에 대한 규제는 국가와 지역마다 다르며, 더 극단적인 경우 탈중앙화 예측 시장인 어거(Augur)는 어떻게 사용하느냐에 따라 도박 범죄를 구성할 수 있다고 한다. 지난 몇 년 동안 기술적인 문제에 대한 해결책이 등장했지만, 법적 문제에 대한 DAO는 새로운 조직 형태이며, 규제와 충돌하면서 시간이 지남에 따라 점차 명확해질 것으로 예상된다.

In this article, I started with what a DAO is, explained its advantages and disadvantages, legal challenges, and some examples of DAOs. Decentralized autonomous organizations that function without human intervention may seem like something out of science fiction, but blockchain-based DAOs have been a reality since the birth of Bitcoin. DAO is an abbreviation for Decentralized Autonomous Organization and is pronounced ‘[dao].’ In Korean, it is translated as ‘decentralized autonomous organization’, and in English it is not uncommon to use ‘DAO’. Although it is sometimes written as a decentralized autonomous organization, DAO is literally an organization that is decentralized and functions autonomously. DAO is one of the application areas of blockchain. Following in Bitcoin’s footsteps, many cryptocurrency projects, services, and platforms have emerged as DAOs. Additionally, as companies and work styles change rapidly, such as automation and remote work, some companies will become DAO/DAC, although not as radical as Consensys.
In a conventional organization, there is an organization such as a board of directors or a person such as a CEO or president who makes decisions centrally, and the organization moves according to those decisions. On the other hand, in DAO, there are rules instead of a central organization. People’s activities are performed according to these rules and can perform automated tasks without a central organization. However, although automated, human intervention is involved in decision-making, implementation, and use, and rule-based deliberation activities are also performed. Blockchain-based DAO implementations describe these rules as programs, which are often implemented as open source smart contracts and maintained by the community.
A future in which various companies and projects function decentralized and autonomously based on smart contracts to raise funds through ICOs, manage funds, and provide transparent and fair services may not be far away. The imbalance of capital concentration and the framework between capitalists and workers, which have been pointed out as problems in capitalist society, do not exist in DAO. Even if someone is the founder of an organization, he/she is basically just one of the token holders like any other participant, and there is no distinction between the company’s managers, full-time employees, and contract employees.
When a decentralized society is realized, people with the same thoughts and hopes will be able to gather regardless of location or status. As more diverse people gather, more information and knowledge is accumulated, creating a virtuous cycle, which leads to the development of the organization. As a result, people will gather in ever-evolving organizations, and new forms of financing, such as NFTs or DAOs, will become possible.
To get started with DAO, one must accurately understand the characteristics of Blockchain technology. Organization operators who want to start DAO in the future will need to study sufficiently. The government should also support the launch of organizations that autonomously pursue projects based on the knowledge and development know-how of blockchain business that has been in progress since the early days of startups. Such policy support is an essential element in the operation of the DAO project. It should also support the release of discord, which is used by many DAO operations.
Although DAOs have many advantages, they also have some disadvantages (challenges). For example, here are some highlights: First of all, slow decision-making as an organization is an obstacle. Additionally, legislation is lagging behind. Additionally, because DAO smart contracts run on globally distributed nodes, ‘conflict of laws’ issues may arise due to different laws in different countries, regions, and jurisdictions. Regulations for cryptocurrencies such as Bitcoin vary by country and region, and in more extreme cases, Augur, a decentralized prediction market, is said to constitute a gambling crime depending on how it is used. While solutions to the technical problems have emerged over the past few years, the DAO’s legal challenges are a new organizational form, and regulatory conflicts are expected to become increasingly clear over time.
