지방교육 거버넌스 구축을 위한 법제도적 방안 (Legal and Institutional Establishment of Local Education Governance)

초록

1991년 지방교육자치를 실시한지 24년이 경과한 현재에도 지방교육자치제가 정착하지못하고 있다. 무엇보다도 지방교육자치를 지방자치의 일부로 간주하고 통합의 효율성과타당성을 중요시 하는 입장과 교육자치의 의미를 ‘교육의 자치’로 이해하여 교육의 자주성․전문성․정치적 중립성을 중시하는 입장이 첨예하게 대립해 왔다. 다만, 최근에는지방교육행정과 일반행정 간의 갈등과 마찰을 줄이고 교육자치의 특성을 살리면서 지방교육행정에서 일반지방자치단체의 지방교육발전을 위한 협력과 지원을 도모하기 위해지방교육자치와 일반자치의 상호 연계․협력을 강화할 수 있는 방안을 강구할 필요가있다는 주장이 제기되고 있다. 이러한 입장은 지방교육 거버넌스(Governance) 구축이필요하다는 주장으로 이해할 수 있을 것이다.
지방교육 거버넌스의 문제는 다른 한편에서는 지방교육자치와 지방행정이 관련 당사자의 협력과 통제, 의사소통을 통하여 규범목적을 달성할 수 있도록 하기 위한 조직․ 절차 및 그 조종과 통제에 관한 법적 틀인 「지방교육자치법」과 「지방자치법」 의 문제로이해할 수도 있을 것이다.
이와 같은 문제를 이해하기 위해서는 무엇보다도 오랫동안 논쟁이 되어온 지방교육자치의 개념․기초 이념․헌법적 근거를 중심으로 한 지방자치와 지방교육자치 간의 관계와 「지방자치법」과 「지방교육자치법」 간의 관계에 대한 이해가 선행되어야 할 것이다.
따라서 이 논문에서는 먼저 지방교육자치의 개념․기초 이념․헌법적 근거를 중심으로 한 “지방자치와 지방교육자치 간의 관계”와 “「지방자치법」과 「지방교육자치법」 간의관계”를 살펴보고, 지방교육 거버넌스를 구축하기 위한 법제도적 방안에 대해서 살펴보았다.

영어초록

It has been 24 years since the autonomy of local education was implemented in 1991, but the system has not yet taken root. First of all, there has been sharp confrontation between two positions; one considers the autonomy of local education to be part of local autonomy and places importance on the efficiency and appropriateness of their integration, while the other understands the meaning of educational autonomy to be “autonomy of education” and attaches importance to the independence, professionalism and political neutrality of education. Of late years, however, a new argument has been raised that it is necessary to seek ways to consolidate mutual linkage and cooperation between the autonomy of local education and the autonomy of local administration, in order to, on the one hand, reduce conflicts and friction between them and make the most of the characteristics of educational autonomy and, on the other hand, to secure cooperation and support from local autonomous bodies in the area of local educational administration for advancement of local education. This argument could be understood to be a position that emphasizes the necessity to establish of local education governance.
The issue of governance of the local education could be viewed from another angle as the issue of between the Local Autonomy Act and the Local Education Autonomy Act, which is the legal framework on organizations, procedures and their coordination and control so that autonomy of local education and local administration can secure attainment of the norm objective through cooperation, control and communication between parties concerned.
To be able to understand the issue, one should first understand the long-debated two issues: “the relationship between the local autonomy and the autonomy of local 150 敎育法學硏究 education” in light of the concept, basic ideology and constitutional ground of autonomy of local education, and “the relationship between the Local Autonomy Act and the Local Education Autonomy Act”.
Therefore, in this article, “the relationship between the local autonomy and the autonomy of local education” and “the relationship between the Local Autonomy Act and the Local Education Autonomy Act” have been first looked at in light of the concept, basic ideology and constitutional ground of autonomy of local education, and then the legal and institutional establishment of local education Governance have been looked for.
