초록

인공지능은 우리나라의 사회전반에 패러다임을 바꿀 수 있는 발전기회임과 동시에 개인의 사생활을 침해할 위험으로 기회와 위험이 병존하고 있다. 인공지능의 중심은 데이터이고 데이터 분석에서 활용가치가 있는 것은 개인정보이다. 개인정보를 활용하기 위하여 고안된 제도가 동의제도이다. 하지만 인공지능은 개인정보가 포함된 대량의 데이터를 수집하고 처리하는 과정에서 정보주체의 개별동의를 받거나 사전동의를 받는 것은 쉽지 않다. 인공지능 정보의 사용에 따른 개인정보보호에 관한 법적연구는 데이터 3법과 관련된 동의제도와 인공지능 규정을 중심으로 서술한다. 입법례는 개인정보보호법의 근간인 GDPR과 진보된 UK GDPR을 검토하고 사후처리 거부권(opt-out)과 신고제도 등을 규정한 일본「개인정보보호법」을 검토한다. 한편 인공지능의 사용으로 인한 데이터 3법「동의권」관련 중요한 법적 쟁점인 개인정보 동의, 미성년자 및 민감정보 보호, 목적 외 이용, 제3자 제공, 공개된 정보, 영리목적 가능성, 비식별화 등을 중점으로 논의한다. 또한 법적 쟁점과 관련하여 현재까지 각종 위원회의 심결과 대법원판결 · 하급심 판결 및 외국 판결 등을 정리하여 서술하고자 한다.

영어초록

Artificial intelligence is a development opportunity that can change the paradigm of Korean society as a whole, and at the same time, there is a danger of infringing on individual privacy, and opportunities and risks coexist. The core of artificial intelligence is data, and it is personal information that has value in data analysis. The consent system is a system devised to utilize personal information. However, in the process of collecting and processing large amounts of data, including personal information, artificial intelligence makes it is not easy to obtain individual consent or prior consent from the information subject. Legal research on the protection of personal information through the use of artificial intelligence information focuses on the consent system and artificial intelligence regulations regarding the three data laws. Legislative examples consider the GDPR, which is the basis of personal data protection law, and the advanced UK GDPR, and the Japanese「Personal Information Protection Act」, which stipulates the post-processing right to refuse (opt-out) and reporting system, is reviewed. On the other hand, there are important legal issues related to the 3 laws 「rights of consent」 for data using artificial intelligence: consent for personal information, protection of minors and confidential information, use for purposes other than the intended purpose, provision to a third party, disclosure Information, commercial potential, de-identification, etc. will be discussed as an emphasis. In addition, regarding legal issues, I will try to summarize the decisions of various committees, decisions of the Supreme Court, decisions of lower courts, and judgments of foreign countries.
