개인정보 법제의 정합성 확보방안에 관한 검토 – 개인정보보호법, 신용정보법, 위치정보법을 중심으로 – (A Study on the Coherence of Personal Information Legislation – Focusing on the Personal Information Protection Act, the Credit Information Act, and the Location Information Act –)

초록

우리나라 개인정보 법제는 개인정보의 처리 및 보호에 관한 일반법이자 기본법인 「개인정보 보호법」과 금융분야의 「신용정보법」, 위치정보 분야의 「위치정보법」 등 각 개별분야의 법률들로 구성되어 있다. 2020년 2월 데이터 3법이 개정되기 전까지는 개인정보 처리 및 보호에 관한 사항이 「개인정보 보호법」과 「정보통신망법」과 「신용정보법」 등으로 분산되어 있으면서 유사·중복문제들이 존재해왔다. 그러나 데이터 3법 개정을 통해 개인정보 거버넌스는 「개인정보 보호법」 중심으로 일원화가 되었다. 또한 최근 2023년 3월 「개인정보 보호법」 2차 개정이 이루어지면서 정보통신서비스 제공자 특례규정이 삭제됨에 따라 정보통신서비스 제공자와 일반 개인정보처리자의 중복규율 문제는 어느 정도 해소되었다는 평가를 받는다.
그러나, 데이터 3법이 시행된 지 3년이 지난 현재까지도 「개인정보 보호법」과 「신용정보법」, 「위치정보법」의 중복규율 문제와 법체계 정합성 문제 등은 완전히 해소되지 못한채 법 해석과 적용의 혼란이 남아있는 상태이다.
본 논문에서는 우리나라 개인정보 법제의 구성과 성격에 대해 살펴보고, 현행 「개인정보 보호법」과 「신용정보법」, 「위치정보법」을 중심으로 우리나라 개인정보 법제의 유사·중복 문제를 살펴본 후, 법체계 정합성의 원칙을 고려한 합리적인 개인정보 법제 정비방안으로서 「개인정보 보호법」의 일반법·기본법으로서의 지위 명확화와 분야별 개별법의 유사·중복문제 해소방안을 제안하고자 한다.

영어초록

Korea's personal information legislation consists of the 「Personal Information Protection Act」, which is both a general law and a fundamental law, and individual laws such as the 「Credit Information Use And Protection Act」, and the 「Act On The Protection And Use Of Location Information」. Until now, Korea's personal information legislation have similar and overlapping problems existed while being dispersed into the Personal Information Protection Act, the Information and Communication Network Act, and the Credit Information Act. However, through the revision of the Data 3 Act in February 2020, it was unified around the Personal Information Protection Act. In addition, in March 2023, the special provisions for provider of information and communications services were deleted through the second revision. Therefore, the problems of overlap between personal information controller and provider of information and communications services have been resolved to some extent.
However, three years after the Data 3 Act took effect, the issue of overlapping regulations of the Personal Information Protection Act, the Credit Information Act, and the Location Information Act still remains. In addition, there has been no complete consultation between ministries on the revision of the Location Information Act, which transfers the processing and protection functions of personal location information to the Personal Information Protection Committee.
Therefore, in this paper, I would like to examine the similar and overlapping problems of Korea's personal information legislation, focusing on the current 「Personal Information Protection Act」, the 「Credit Information Use And Protection Act」, and the 「Act On The Protection And Use Of Location Information」. Next, as a reasonable way to improve the personal information legislation in consideration of the principle of coherence of the legal system, we would like to clarify the status of the 「Personal Information Protection Act」 as a general law and a fundamental law.
