약물사범 재범방지를 위한 개입방안 – 형의 일부집행유예제도를 중심으로 - (Interventions for Preventing Re-offenses of Drug Criminals - Focusing on Partially Suspended Sentence)

초록

약물사범 특히 단순투약자의 경우 치료적 개입을 하는 것이 세계적으로 공통된 현상이며 우리나라도 예외는 아니다. 현행법상 치료보호, 치료감호, 치료명령 등과 같은 치료적 처우 방안이 마련되어 있다. 그럼에도 불구하고 약물사범 3명 중 1명은 재범을 저지르고 있어 현행 제도의 유효성에 관한 검토가 시급하다 하겠다. 특히 약물사범에 대해 치료적 개입만을 하는 경우가 적지 않은데 형벌이 아닌 치료적 개입만으로 재범을 억제할 수 있는지에 대해 의문이 남는다. 엄벌만이 능사는 아니지만 단기자유형 등의 경고기능을 경시해서는 안 된다. 단기간의 구금은 피고인에게 법질서의 엄격함을 깨닫게 해주는 교육적인 효과가 있기 때문이다.
불법 약물 투약자는 다른 범죄자에 비하여 죄의식이 부족하다는 특징이 있으며 더욱이 치료적 개입만 이루어진 경우 이를 강화시킬 우려가 있다. 약물사범에 대한 치료의 필요성은 인정되지만 그들이 범죄자라는 점을 간과해서는 안 된다. 치료 중심 처우를 통한 재범방지 효과와 더불어 형벌 부과를 통한 범죄 억제 효과에 대해서도 살펴볼 필요가 있다.
이에 본 연구에서는 일본의 약물사범에 대한 형의 일부 집행유예제도에 관하여 검토하고자 한다. 동 제도는 법원이 선고한 형의 일부를 실형으로 하고 남은 형기의 집행을 유예함으로써 약물사범이 출소한 후에도 지속적인 치료·관리가 가능하다는 점에서 재범방지에 기여하고 있다. 구체적으로 본고에서는 먼저 우리의 약물사범에 대한 치료적 처우에 대해 검토하도록 하겠다. 그리고 일본의 일부집행유예제도에 대해 비판적으로 고찰하여 우리가 나아가야 할 방향을 정하는데 발판으로 삼고자 한다.

영어초록

The therapeutic intervention is a common countermeasure for drug criminals, especially simple drug users, over the world including Korea. The rehabilitative treatment measures for drug criminals are prepared, such as the treatment protection order system under the Narcotics Control Act and the medical treatment and custody system/treatment order system under the Act On Medical Treatment And Custody. Nevertheless, one of three drug criminals commits re-offenses, so it is urgent to review its validity. In particular, there remains a question, ‘can only therapeutic interventions except for prosecution suppress re-offenses?’, where only therapeutic interventions are often applied to drug criminals. Although a severe punishment is not always a right thing, the warning function of the short term imprisonment should not be ignored, because short-term custody has an educational effect on the accused, in that it make him/her realize the rigor of legal order.
Illegal drug users are characterized by less guilt, compared to other criminals, so it is concerned that such a character would be exacerbated, if only therapeutic interventions are made. Although the need for treating drug criminals is recognized, the fact that they are offenders should not be ignored. It is, therefore, necessary to examine our rehabilitative treatment’s preventive effect on re-offenses, as well as the deterrent effect of imposed punishment on crimes.
This study thus aims to examine the partially suspended sentence on drug criminals in Japan. The system contributes to preventing re-offenses, in that it allows drug criminals to continuously receive the treatment after leaving prison, by determining a part of a sentence passed by a court of justice as a prison sentence, but suspending the execution of the remaining prison term. Although it has not been conducted for the combination between punishment and therapeutic interventions, which was stressed above, it is positively evaluated from such a perspective, and also has a significant implication for us. Specifically, this study intends to find out the way to proceed, by reviewing the treatment for drug criminals and critically considering the Japanese case.
