영어초록

In the United States, enforcement of a court judgment is perceived as a form of administrative action, not a judicial action. A sheriff (a U.S. marshal or a state sheriff), a civil servant who belongs to the executive branch, takes the role of a levying officer who plays a primary role in the enforcement of civil judgments. This affects the way in which information needed for enforcement of a court judgment is collected and handled and the results of enforcement, as follows: First, U.S. courts do not have a duty to collect the information needed to enforce their judgments. Second, in the United States, in order for a claim to be satisfied through enforcement of a court judgment, a judgment creditor must himself verify information on the judgment debtor (the defendant) or any related third party and their properties needed for enforcement. A judgment creditor can obtain the information needed to enforce the judgment through so-called post-judgment discovery. Third, in the United States, to enforce a court judgment, the judgment creditor asks the levying officer to enforce it, while providing the officer with the necessary documents and information for enforcement. The information required to enforce a court judgment is primarily about the personal information of the person served that the judgment creditor is aware of, including unique identification information such as the judgment debtor's social security number. California law gives special protection to social security numbers. The California law also stipulates that when a judgment creditor provides a levying officer with information necessary for enforcement of a judgment, it shall be done in the form of written instructions with the signature of the judgment creditor’s legal representative or, in the absence of a legal representative, the judgment creditor. The law also provides that the levying officer shall not be held liable even if the judgment was not correctly enforced, as long as it was enforced according to the written instructions provided by the judgment creditor.
