초록

공익사업을 위한 토지 등의 취득 및 보상에 관한 법률”을 일반법으로 하는 현행 이주대책은 이주자택지, 이주주택, 이주정착금 등 기존의 보상 방식에 따르고 있는데 이는 단순한 물질적 보상에 그치고 있어 종전의 생활 상태를 회복시키기 위해 시행되는 이주대책의 취지가 제 역할을 하지 못하고 있다.
따라서, 현재는 이주대책대상자들을 보다 조속하게 종전 생활 상태로 복귀시킬 수 있는 다양하고 현실적인 보상 요인들의 시행이 필요한 시점이라고 할 수 있다.
이에 본 연구는 사업시행자나 이주대책대상자에게 점증하는 보상의 실시에 따르는 긍정적인 효과로써 사업시행의 원활과 이주자들의 만족도를 지향하고 현재의 상황에 적합하도록 보상 요인을 선별하고 전문가들을 상대로 계층 분석적 의사결정방법(AHP)을 사용하여 이주대책 보상요인의 중요도를 분석함으로써 이주대책의 발전적 방안을 제시하였다.

1. CONTENTS

(1) RESEARCH OBJECTIVES Approaching from the perspective of recovering the living environment, this study attempts to seek various support measures including the physical compensation for expropriated residents who are deprived of community living environment in the process of housing site development. This study has the objective of suggesting a constructive measures for the relocation plan.
(2) RESEARCH METHOD In relation to previous studies, the study reviews laws, regulations, case laws and related theories including literature study to draw factors for relocation measures. The study attempts to draw effective relocation measures for the residents using importance analysis by each factor through expert brainstorming process and analytic hierarchy process (AHP).
(3) RESEARCH FINDINGS The findings from analyzing factors of relocation measures using AHP in expert group showed that the conventional compensation methods of substitute compensation and monetary compensation scored the highest points. This is comparable to the local government’s support measures or taxation supports, which scored relatively low points. These government measures were introduced with the purpose to expand the unbalanced conventional compensation measures and to take measures for recovery of living in the long term perspective, however the measures showed to have low awareness or low direct display effect of compensation.
2. RESULTS These compensation measures are not sufficient for the residents to maintain the previous living standard or environment. Besides, there’s high probability that living environmental problems in relation to settlement of secured living or job may occur. Besides, regarding the sense of loss caused by community separation, it would need to improve the compensation factors to provide relocating residents with economic, social, cultural and psychological security, to enable them to return to their previous lifestyle and to recover their community-organic relationship.
