지방자치단체와 지역문화재단간 거버넌스 실태분석 (An Analysis of the State and Channels of Political-Administrative Intervention in Regional Culture Foundations)

초록

본 연구는 지역문화재단의 미래가 근본적으로는 지방자치단체장의 지역문화재단에 대한 정치·행정 개입으로부터 독립성과 자율성의 확보에 달렸다는 문제의식 아래, 지역문화재단에 대한 정치·행정 개입의 경로와 실태를 5개 광역문화재단의 사례비교를 통해 분석함으로써, 지역문화재단의 자율성이 처해 있는 현주소를 파악하고, 이를 바탕으로 문화민주주의의 실현과 진정한 문화 분권의 방향을 모색코자 했다.
연구결과로서 첫째, 지자체의 관리감독권한이 지역문화재단의 운영을 일반 행정원리에 따라 관리∙감독하도록 하는 경로를 제공하고 있으며, 둘째, 보다 직접적인 정치⦁행정적 개입은 지역문화재단내에 공무원 파견, 예산편성기준, 계약 및 회계기준, 업무 처리 절차 등을 통해 경로화 되고 있으며, 셋째, 지역문화재단의 정책결정과정도 대표이사의 이해관계가 가장 큰 영향력을 미치고, 이사들의 의사결정권은 형식적이고 행정 편의주의에 의해 제한적으로 행사될 뿐만 아니라 지방자치단체와 지역문화재단 간의 긴밀한 파트너쉽도 아직 구축되지 못하고 있다는 점을 분석⦁제시하였다. 이를 토대로 지역문화재단이 지방자치단체·지역문화예술단체·지역민들과의 거버넌스를 통해 재단의 설립취지와 목적에 부합하는 독창적이고 전문화된 사업의 개발과 운영을 해 나가기 위해서는 도덕성과 상호 신뢰를 바탕으로 행정과 재단간의 적정한 규제와 자율성의 보장임을 제언했다.

영어초록

With a critical view that the future of regional cultural foundations depends on the assurance of independence and autonomy from political-administrative intervention by local government heads, this study looks at the present state of autonomy in regional cultural foundations through an analysis of the state of and channels of political-administrative intervention in regional cultural foundations by comparing five regional cultural foundations, and based on this, explores the direction of authentic cultural decentralization and the realization of cultural democracy. The results of the study are, first, that the local government’s management-supervision authority provides the channel that allows the management-supervision of the operation of regional cultural foundations, based on general administrative principles. Second, direct political-administrative intervention is being channeled through methods such as business operation procedures, budget planning standards, and the dispatching of civil servants to work in regional cultural foundations. Third, the author analyzes and points out that the interests of the chairmen exert the greatest influence on the policy decision-making process of regional cultural foundations, the decision-making power of board members is a formality, not only limited due to administrative opportunism, but also because close partnerships between local governments and regional cultural foundations have still not been built. Based on this, it is suggested that an effort be made to assure reasonable regulation and autonomy between administrative bodies and foundations, based on morality and mutual trust, in order to allow regional cultural foundations to run and develop creative and professionalized services that correspond to the objectives and founding purposes of the foundations through a combined governance by local governments, local cultural art organizations, and local citizens.
