한국과 베트남, 태국, 필리핀 간 국제공조수사 비교 분석 (Comparative Analysis of international cooperative investigation between Korea and Vietnam, Thailand and the Philippines)

초록

이 연구의 목적은 베트남, 태국, 필리핀과 대한민국 간 그동안 이루어졌던국제공조수사에 관해 분석하고, 이를 바탕으로 최근 발생하고 있는 동남아시아관련 국제범죄의 특성에 적합한 공조수사의 방향을 제시하는 것이다. 이를 위해 본 논문에서는 동남아시아 지역 내 개별 사례들을 분석함으로써 기존 국제공조수사의 보편적인 방식이 최근 국제범죄의 동향에 비추어 적합한지, 아니면일부 변경이 필요한지를 검증하였다.
연구 결과, 베트남은 경제범죄 측면에서, 태국은 마약범죄 측면에서, 필리핀은 강력범죄 측면에서 독특한 특징을 보였으며 공통적으로 현지 수사관으로 구성된 해외도피사범 전담추적팀이 있거나 한국에서 전문 검거팀을 급파한 경우, 현지 수사관이 한국에서 파견된 정보요원과 실시간으로 소통하여 통신수사 결과 및 위치 추적 자료를 공유한 경우에 성공적인 공조가 이루어졌다.
신종 국제범죄에 대응함에 있어서 기존 외교적 채널를 활용한 협력은 많은한계를 갖는다. 기존에 취약점으로 지적되어 온 수사인력의 부족문제는 분야별전문화된 민간보조인력의 체계적인 활용을 통해 보완할 수 있을 것으로 보인다. 특히 민간 인력은 다크 웹 모니터링, 가상자산의 흐름 추적과 같은 분야에서 활용될 수 있으며 선발단계에서부터 체계적으로 관리한다면 경찰의 핵심 치안 활동을 지원하고 수사인력 부족을 보충하여 국제범죄에 대응함에 큰 도움이 될 것으로 예상된다.
이 글에서는 기존에 국제공조수사 분야에서 많이 연구되지 않았던 동남아시아 지역, 특히 베트남, 태국, 필리핀의 사례에 집중함으로써 각 국가별 국제범죄의 특성을 파악하고 그 특성에 따른 수사인력 및 기술상 한계를 보완하기 위해 민관협력을 통한 대응 방향을 제시하였다. 이 연구는 앞으로 한국과의 교류가 증가할 것으로 예상되는 다른 동남아시아 국가들과의 국제공조수사 방향을 설정하는 데에도 이정표로 활용될 수 있을 것으로 기대한다.

영어초록

The aim of this study is to examine previous international cooperative investigations involving Vietnam, Thailand, the Philippines, and South Korea, and to propose strategies for enhancing cooperation in response to evolving trends in international crime in Southeast Asia. To achieve this objective, the study assesses whether conventional methods of international cooperation remain effective given current crime patterns in the region or require adaptation, by analyzing specific case studies.
The findings indicate that Vietnam, Thailand, and the Philippines each exhibit distinct crime profiles, primarily characterized by economic crime, drug-related crime, and violent crime, respectively. Successful cooperation was observed when specialized local teams pursued fugitives abroad or when South Korea deployed dedicated apprehension units. Effective outcomes were also achieved through real-time communication between local investigators and South Korean intelligence officers, facilitating the exchange of telecommunication surveillance data and location-tracking information.
Traditional diplomatic channels for international cooperation have shown limitations in responding to new types of transnational crime. One potential solution to the persistent issue of insufficient investigative manpower lies in the systematic integration of civilian personnel. Specifically, civilian experts can support key law enforcement activities, such as "dark web monitoring" and "virtual asset tracking." If managed systematically from recruitment onward, civilian personnel could play a critical role in augmenting police capabilities, addressing manpower shortages, and enhancing the overall response to international crime.
This study focuses on Southeast Asia—particularly Vietnam, Thailand, and the Philippines—regions that have received relatively limited attention in the context of international cooperative investigations. By analyzing the characteristics of international crime in these countries, the paper identifies existing limitations in investigative personnel and techniques. To mitigate these challenges, it proposes strategies involving public-private partnerships. This research aims to serve as a foundation for shaping future cooperative investigation frameworks with other Southeast Asian countries likely to increase engagement with South Korea.
