한반도형 남북규약의 내용과 방향: 필요 조직과 각 조직 운영 및 재정확보방안을 중심으로 (The Contents and Directions of the Korean-Penninula Type of North and South Confederation Agreement : Focused on Necessary Organization, Operation of Each Organization, and Solution of Financial Secur)

초록

2015년 분단 70년, 해방 70년이 되는 해이다. 2015년 8월 초에 목함지뢰사건으로 남북한 간에는 전쟁 일보 직전까지 가는 상황을 초래하였으나, 남북한 간 고위당국자들의 현명한 대처로 8.25합의를 이끌어내었다. 그러나 현재 북한의 제4차 핵실험으로 한반도 및 동북아가 초긴장사태이다. 그렇지만 이를 슬기롭게 극복하고, 8.25합의사항이 성과를 거둔다면 남북연합의 설치가 현안이 될 수 있다. 그래서 이 논문에서 국가연합사례로 미국연합, 북독일연합, 유럽연합을 살펴 보았다. 그러나 한반도에 그대로 적용할 수 있는 국가연합 사례는 없었다. 한반도 특수상황을 고려하고, 북한이 수용할 수 있는 한반도형 국가연합이 필요하다는 판단을 하였다. 구체적 내용을 기술하면 한반도형 남북연합의 기능과 역할은 첫째, 과거 합의를 통한 신뢰회복 기구 역할, 둘째 한반도의 평화와 안정, 셋째 평화통일의 준비기구 역할을 해야 한다고 판단하였다. 이를 위해 한반도형 남북연합의 필요조직은 최고의사결정기구로 유럽연합이사회와 같은 남북정상회의, 이행기구로 유럽연합각료이사회와 같은 남북총리회담 및 각료회담을 들었고, 실무기구로 유럽연합집행위원회와 같은 남북공동사무국 설치를 주장하였다. 그리고 한반도 특수성이 제일 크게 반영된 7.4공동성명이행위원회, 6.15공동선언이행위원회, 10.4정상선언이행위원회, 8.25합의이행위원회 등 기존 남북합의사항이행을 통한 신뢰회복을 위해 남북합의이행위원회를 주장하였다. 그리고 통일준비를 위한 특별위원회로 통일헌법제정위원회와 통일교육위원회 등의 설치를 주장했다. 각 조직의 운영으로 특수다수결 원칙과 만장일치제도의 운영을 주장하였다. 그리고 재정확보방안으로 남북한 경제력에 의한 부담금, 관세, 차후 비무장지대에 설치될 생태평화공원 등 관광세, 국채, 평화도시에서 나온 세금 등으로 재정을 확보하여야 한다고 판단했다.

영어초록

The year 2015 is 70 years of division and liberation. The situation between North and South Korea was on the point of war because of PMD series mines case, but the high-level officials of North and South Korea elicited 8.25 Agreement because of their wise response. Although the Korean peninsula and Northeast Asia is extremely alarmed because of the 4th nuclear test of North Korea, if it can be overcome wisely and the terms of 8.25 Agreement achieve good results, the installation of North and South Confederation can be the question at issue. Thus, for the examples of confederation, this paper has examined the United States, the North German Confederation, and EU. However, there was no example which can be applied to the Korean peninsula as it is. This paper suggests that the Korean confederation is needed that can consider the special situation of the Korean peninsula and North Korea can accept. To put it concretely, the function and role of North and South Confederation is as in the following: First, the role of the organization of restoring trust through the past agreement; Second, peace and stability of the Korean peninsula which was pursued by the existing confederations; Third, the role of readiness agency of the peaceful unification. The necessary organizations for these are as in the following: Inter-Korean summit meeting as a decision-making body; Inter-Korean prime minister and ministerial meeting as an executive body; North-South joint office as a business body. This paper argues that for the trust restoration, the North-South agreement implement committee such as 7.4 joint statement implement committee, 6.15 joint declaration implement committee, 10.4 summit declaration implement committee, 8.25 agreement implement committee should be established. Furthermore, it also suggests that as a special committee, unification constitution establishment committee and unification education committee should be established. For the operation of each organization, it is necessary to establish the special majority rule and unanimity rule. As for the solution of financial security, it is argue that finance of the confederation should be secured by shares in proportion to the North-South economy, customs, tourist tax from the eco-peace park, which will be later installed in DMZ, and taxes from state bonds and peace cities.
