시청각장애인의 『헬렌켈러법』 도입을 위한 해외 사례 연구 (A Comparative Study on the International Cases for the Introduction of the Helen Keller Act)

초록

본 연구는 일명 『헬렌켈러법』으로 불리우는 시청각장애인을 위한 사회서비스 지원 법률의 필요성을 제기하면서 해외 법률사례를 검토하였다. 사례대상은 국제법과 미국 및 영국의 관련 법률이다. 국제적인 시각에서 시청각장애인의 법률적 근거로 『장애인권리협약(UNCRPD)』과 『시청각장애인 권리선언』이 있다. 이 중 『시청각장애인 권리선언』은 많은 국가에 시청각장애인을 위한 법률적 근거로서 법적인 효력을 미치고 있다. 『시청각장애인 권리선언』에 따라 국제 사회는 시청각장애인을 별도의 장애로 인정하고 있다. 그리고 시청각 장애인의 욕구가 복합적이며 이들을 위한 통합적이고 다각적인 서비스 및 지원이 이루어져 시청각장애인이 지역사회에서 독립된 주체로서 인간답게 생활할 것을 강구하고 있다. 미국의 경우 일명 『헬렌켈러 지원법』이라는 명칭으로 1967년 시청각장애인지원법이 마련되었다. 이 법은 헬렌켈러 센터를 설립하는 법적 근거를 마련했으며 미국의 시청각장애인을 위한 별도의 훈련과 자원을 지원받도록 하고 있다. 영국은 미국과 달리 개별법이 존재하지 않으며 성인은 『돌봄법』과 아동은 『지방정부사회서비스법』 의 근거를 토대로 지방정부의 『시청각성인아동을 위한 시행지침』을 만들어 지역기반의 통합적 사회지원서비스를 제공하고 있다.

영어초록

This study explore international cases, raising the issue for social service support laws for the deafblind. The targets were international law, the United States, and the United Kingdom. In the international community, people with hearing and sight impairments are recognized as separate obstacles, and related international laws are prepared and internationally urged to pay attention and support to the people with hearing impairments. Currently, there are the United Nations Convention on the Rights of the Disabled (UNCRPD) and the Declaration of the Rights of the deafblind, which were enacted in 2006 as legal grounds for the deafblind who have had a lot of national impact. The “Declaration of Rights for the deafblind” seeks to ensure that the deafblind have a complex need and integrated and diverse service and support for them to live as a human being as an independent entity in the community. Under the name of the Helen Keller Support Act, the United States established the deafblind Support Act in 1967. The law focuses on the Helen Keller Center, which allows people with visual and hearing impairments to receive separate training and resources only for them. Specifically, the main focus of support is “education.” There is no separate law for the deaf in the UK. The Local Authority Social Services Act 1970 is the Local Authority Social Services Act, with the Care Act 2014 under paragraph 78 of the Care Act. In each province, the Care and Support for Deafblind Children and Adults Policy Guidance was established to prepare specific issues for local governments. It emphasizes the responsibility of local governments and focuses on social care and support. In terms of international cases, Korea should legally establish a definition and category of the deafblind so that they can be provided with appropriate salaries and services. However, provisions on the basis for social services and support for the deafblind should be prepared to enable them to carry out their daily lives independently of the community.
