니카라구아와 온두라스간의 해양경계사건 분석 (An Analysis of Maritime and Territorial Dispute Between Nicaragua and Honduras)

초록

니카라구아와 온두라스의 해양경계사건은 절차적․실체적으로 흥미로운 쟁점들을 제기하였다. 절차적으로는 하나의 사건에 중미사법재판소(Central American Court of Justice, 이하 CACJ), WTO 분쟁해결절차, ICJ 등의 세 개의 분쟁해결기관이 이용되었다는 것과, 소장에서 언급하지 않은 섬의 영유권 문제를 심리의 대상으로 했다는 것이다. 실체적 측면에서는 해양경계설정방법으로 이등분선(bi-sectoral line) 방법을 적용했다는 것이 가장 특징적이다. 이 외에 육지에서 멀리 떨어진 가치가 적은 섬에 uti possidetisd 원칙을 적용하는 문제, 결정적 기일, 실효적 점유, 지도의 증명력, 지리적 근접성 등의 쟁점도 다루어졌다.
중미사법법원에서 진행된 절차를 보면 분쟁당사국이 해당 재판소를 신뢰하지 않으면 국제재판소는 분쟁을 해결할 수 없다는 것을 다시 한 번 확인시켜주었다. 다만 CACJ를 이용함으로써, 분쟁해결에 대한 자국의 의지를 표현하고, 궁극적으로 ICJ에서의 분쟁해결을 이끌었다는 것에서 니카라구아의 전략은 어느 정도 성공한 것으로 평가된다.
소장에 기재되지 않는 청구에 대한 심리는 “원래의 청구와 일반적인 관련성이 있으면서, 추가적인 청구가 원래의 청구에 묵시적으로 포함되어 있었거나 혹은 소장의 주제인 문제로부터 직접적으로 발생하는 것이면 심리의 대상이 된다”라는 법리에 의해 해결되었다.
이 사건은 섬의 영유권문제와 해양경계설정의 두 개의 문제로 구성되어 있다. 섬의 영유권 문제를 해결하기 위하여 uti possidetis 원칙, 결정적 기일, 지도의 증명력, 제3국의 묵시적 승인, 실효적 점유의 여부, 지리적 근접성 등의 쟁점을 다루었다. 이런 쟁점을 해결함에 있어 ICJ는 기존의 법원칙을 다시 한 번 확인하였다. 다만 결정적 기일에 관한 법리에 대해서는 국제 판례가 일관성이 부족하였는데, 이 사건에서는 전통적인 법리를 다시 한 번 확인하였다는 것이 특기할 만하다. 즉, ICJ는 “분쟁이 구체화된(crystallized) 시점이 결정적 기일이고 결정적 기일 이후의 사건은 고려하지 않는다”는 전통적 규칙을 이 사건에서 적용하였다.
해양경계설정에 있어 이 사건의 가장 큰 특징은 해양경계설정에 이등분선을 적용하는 것이다. 이등분선 방법은 ICJ가 20여 년 동안 적용하지 않았던 방법인데 이 사건에서 적용하였다. ICJ가 이등분선 방법과 관련하여 제시한 법리를 정리하면 다음과 같다.
1. 이등분선도 등거리선 방법과 마찬가지로 형평적 해결에 도달하는 방법이다. 다만 등거리선 방법은 미시적 해안지형을 고려하는 것인 반면에, 이등분선 방법은 거시적 해안지형을 고려한 것이다.
2. 이등분선 방법은 등거리선 방법을 적용하는 것이 불가능하거나 부적절한 경우에 적용된다.
3. 이등분선을 설정하면서 가장 중요한 고려사항은 해안지형이다.
4. 이등분선을 설정하기 위한 기준선은 해안의 전체적인 모습을 적절하게 반영하는 것이면 기준점과 국경점을 연결하는 전체적인 해안선을 반영하는 선일 필요는 없다.
해안의 거시적인 모습을 고려하는 이등분선 방법의 채택으로, 국제재판소가 해양경계를 설정함에 있어 선택의 폭을 넓힌 사건으로 이 사건을 평가할 수 있다. 앞으로 해양경계설정에 많은 영향을 미칠 사례로 생각한다.

영어초록

This case presents interesting issues in procedural as well as substantive aspect. One interesting procedural feature of this case is that not only the ICJ but also the WTO dispute body and the Central American Court of Justice(CACJ) were involved in this case. The role of the CACJ was interesting in this case. Its effectiveness was limited by the lack of confidence and compliance by both parties, which Nicaragua itself knew very well. But the utilization of the CACJ by Nicaragua was arguably a success in drawing Honduras' attention to the case and in bringing it ultimately to reliable forum, the ICJ.
Another important procedural issue was the admissibility of new claim which had not been presented in the Application. The issue was decided by the rule that an additional claim must have been implicit in the Application or must arise directly out of the subject-matter of the Application.
As for the substantive issues, there were two disputes in this case: sovereignty over islands and maritime delimitation.
In order to determine sovereignty over islands, the Court considered the issues of uti possidetis juris, evidentiary value of maps, recognition by the third states, and effectivités. In determining all these issues, the Court followed traditional rules on the issues. One thing to be mentioned here is that the Court re-emphasized the traditional rule on the critical date, which has not been applied uniformly. The rule provides that the tribunal cannot take into consideration those acts having occurred after the date on which the dispute between the parties was crystallized, unless such acts are not a normal continuation of prior acts.
After finding that the arguments based on the other reasons were not persuasive, the court determined the sovereignty of the islands, relying on effectivités. In this process. the Court applied the traditional rule for effectivités to the evidences presented. The rule provides that in order for a particular act to be a display of authority, two elements should be shown to exist: the intention and will to act as sovereign, and some actual exercise or display of such authority. While not numerous, the evidences presented by Honduras were taken to meet these requirements. For this reason, the Court found that Honduras was sovereign over the 4 islands concerned.
As for the maritime delimitation, several issues were presented, such as the issues of uti possidetis juris, recognition by third states, and effectivités. After deciding the arguments based on these issues were not persuasive, the Court drew new maritime boundary. In the process of delimiting the maritime boundary, the Court encountered a fundamental problems: unstable geomorphology at the mouth of the River Coco. For this geomorphological problem, the Court turned from the traditional equidistance rule to the bisectoral method. Like equidistance rule, the bisectoral method is based on the coastal geography. But the difference between the two is that while the former responds to only the most prominent micro-geographic features, the latter takes the general coastal features. The use of bisectoral method in maritime delimitation in this case may have a significant impact on future maritime delimitation. This decision might allow more flexibility in the choice of method in future maritime delimitation disputes.
