초록

제도적인 교육으로서의 학교교육은 국가구성원인 개인의 능력을 발굴하고 개발시켜 이들이 국가구성원으로서의 필요한 자질을 갖추게 함으로써 국가가 계속적으로 유지될 수 있는 기반을 형성한다. 따라서 학교교육에 관련된 모든 본질적인 결정과 그 형성은 국가가 행하고 있다. 그러나 다른 한편으로는 국가의 구성부분임과 동시에 자치행정의 주체인 지방자치단체도 자신이 관할하는 구역에서의 공교육을 수행하는 주체로서의 법적 지위를 보유하기 때문에 국가의 교육행정과 지방자치단체의 교육행정은 법적 거버넌스 관계에 있다고 할 것이다.
독일 연방헌법 제7조 제1항에 의하면 개별연방주들은 학교제도와 그 운영에 관한 총체적인 지배권으로서의 교육고권을 보유하는 바, 개별연방주들의 교육고권의 내용과 범위에는 학교교육목적과 그 방향, 학교교육의 과정과 그 단계, 학교의 종류와 학교조직의 기본구조, 의무교육의 실시와 그 운영, 하급교육행정조직의 설치·운영과 그 권한의 확정에 관한 형성과 규율뿐만 아니라 개별 학교와 교원에 관한 지도 및 감독, 교원의 채용·훈련·교육, 입학자격, 수업계획과 그 운영, 학력인정, 수업교재의 채택, 시험제도, 개교시간, 학교 및 학급당 적정 학생수, 수업일수, 사립학교의 인가, 방학 및 휴교, 학생의 진급, 교육의 질적 확보와 그 수준향상, 특별교육시설의 설치와 운영 등에 관한 형성과 규율도 포함된다. 우리나라와는 다르게 독일에서는 지방자치단체의 교육행정수행주체로서의 교육감이 없고, 우리나라의 교육감이 수행하는 학교교육행정권은 대부분 연방주의 권한으로 유보되어 연방주가 직접 수행하거나 또는 연방주에 의하여 설치된 지방교육행정청을 통해 행사하고 있다.
독일 지방자치단체의 자치행정권으로서의 학교사무는 학교의 설립·변경·폐교, 학교발전계획의 수립, 외부적 학교사무(학교건물의 건축과 유지, 학교시설의 설치와 유지, (행정)직원의 채용, 학교물품의 구매, 수업교재의 준비와 공급 등)에 한정되어 있다. ‘국가의 총체적이고 광범위한 학교감독권’으로 인하여 지방자치단체의 자치행정권으로서의 학교사무수행권이 제한되어 있는 것은 사실이지만, 독일 개별주들의 학교법은 이에 대한 보상으로서 지방자치단체의 연방주의 교육정책 및 교육제도형성에 관한 참여와 협력가능성을 부여하고 있다.
독일 지방자치단체의 자치행정사무로서의 학교행정사무는 자치행정을 통할하는 지방자치단체의 장과 의결·통제기관으로서의 지방의회의 상호작용에 의하여 수행되는 바, 지방의회에 설치되는 학교위원회에는 개별학교의 학부모대표, 학생대표, 교원대표들이 구성원으로서 자문적 참여를 하고 있다. 우리가 교육자치를 지방자치단체에 의한 자치행정권으로서의 학교교육행정의 수행으로 이해하는 것과는 달리 독일에서의 교육자치란 교육고권을 바탕으로 한 개별연방주의 광범위한 교육형성권, 학부모·교사·학생의 주교육정책형성과정에서의 참여와 협력 및 이를 전제로 한 학교의 자치를 의미하는 것이다.

영어초록

A school education in from of an institutional education excavates and develops the ability of the individual who is a national member. This education does to equip the individuals a qualification which is necessary to form the base which the nation could be maintained continuously.
Therefore the nation makes all essential decisions which relates in a school education. on the other hand the national educational Administration and an educational administration of the local government are in relationship of a legal governance.
The local government as a component of the nation and a legal subject of the autonomous administration has the legal position which accomplishes the public education.
According to the first paragraph of article 4 of the german constitution each state has the educational sovereignty which means a general supremacy over the school system and its operation.
The educational sovereignty of the states includes a regulation on a object of the school education and its direction, a process and a steps of the school education, a type of the school and a basical structure of the school organization, the compulsory education, an administrative organization of the education, an instruction and a supervision on the teacher and the employee, an adoption and a training of the teacher, the entrance requirements, a instructional planning and a class operation, a recognition of the school achievement, the textbooks, the examination system, the number of school days, the permission of the private school, a school vacation and a closing of school, the class promotion, an improving of the education, an installation and an operation of the special educational facilities and so on.
Contrary to the korean educational system there is no superintendent of education in german education system. A state government in Germany has a most of the educational authorities. it exerts its authorities itself or through an lower administrative agency, which has by the each state government organized.
The school administration of a german local government as an autonomous administration is limited to a foundation, a change and an abolition of the school, an establishment of the school development, a external school administration(a construction and a maintaining of the school, an adoption of the teacher and the employee), a purchasing school articles, a preparation and a supply of the class materials and so on).
Owing to an general and an far-reaching oversight of the central government the local government authorities to a school administration have been restricted. Nevertheless the german school act regulates the participation of the local government in the educational policy making process of the central government. The educational administration of the local government performed by a local government head and a local council interactively. The school parents representatives, the student representatives and the teacher representatives participate in the school committee, which is in the local council installed. There they do a consultative function.
Different to Korea the education autonomy in German means the self-governing school, the general and the far-reaching oversight of the state government and the participation and the cooperation of the parents, the students and the teachers in the educational policy making process.
