초록

오늘날 국가기능의 변화는 행정입법의 증대를 가져왔고, 개인의 국가급부에의 의존도를 더욱 높여 왔다. 이에 포괄적인 위임입법과 자의적인 행정입법의 통제에 대한 필요성이 더욱 강조되고 있지만, 여전히 급부행정영역에 있어서는 헌법재판소와 대법원은 완화된 심사척도를 적용하여 왔다.
위임입법의 위헌성을 심사하고, 위임입법의 한계를 결정짓는 것은 결국 사법부이기에 헌법재판소와 법원의 역할이 더 중요할 수밖에 없다. 현대 사회에서 기본권 실현의 전제조건을 형성하는 국가의 적극적 활동, 특히 급부의 의미를 살펴볼 때, 또한 침해와 수익, 또는 급부의 구분이 희미해져 감에 따라서, 수익적 법률에서의 법률유보와 포괄적 위임입법 금지 및 평등원칙 역시 -비록 국가기능적인, 법기술적인 예외사항을 고려해야 하지만- 침해적 행정에서와 마찬가지로 엄격하게 심사되어야 할 것이다. 더 나아가 사회적 기본권이든 법률에 의한 보상이라는 법적인 권리를 부여하는 급부적 내용의 법이든, 자의적인 차별이 없어야 하는 것이 헌법의 기본원리라는 것을 유념하여야 한다.

영어초록

In modern society, the transformation of function of government - from traditional passive to constructive and affirmative - has greatly increased instances of administrative rule-making, and it has been observed the aggravated dependence of individuals on governmental benefits and subsidies as well. Accordingly, the necessity to control blanket delegation of legislative power to administrative branch and arbitrary administrative regulation has been more and more emphasized. Nevertheless, the Constitutional Court and Supreme Court of Korea have applied moderate standard of review in the area of social welfare administration.
Eventually, it is the judiciary that reviews and decides the constitutionality and legality of delegation of legislative power and administrative rule-making thereof and one cannot say too much that the role of the constitutional court and general court is critical to protect and guarantee rights and freedoms of individuals in the area of legislative delegation. Social welfare program of state has become very crucial as it forms the precondition of individual rights and equal freedom, and thus in social welfare state, it is not really meaningful to strictly distinguish intrusive and infringing administration from subsidizing and benefiting administration with respect to statutory reservation, prohibition of blanket delegation and equal protection principle. Though the court should consider the exceptional conditions regarding state functionalism and legal technicalities, it should review social welfare administration strictly as it does with intrusive administration.
Furthermore, regardless of whether it is about constitutional social rights or statutory rights for social welfare benefits, it is the very fundamental principle of Constitution that protects individuals from arbitrary discrimination by government.
