등급분류제와 청소년유해매체물 제도의 관계 (Legal Relation of Classification and Harmful Media to Youth)

초록

1997년 청소년보호법 제정을 통해 독일 법제의 영향을 받은 청소년유해매체물 제도가 도입되었고 같은 해에 영화진흥법을 통해 영화상영 등급분류제가 도입되었다. 두 제도는 유해한 매체물로부터 청소년을 보호한다는 같은 취지를 가지고 있기 때문에 독일과 한국을 제외하고는 함께 시행하는 경우가 없다. 독일 청소년보호법에서는 등급분류된 매체물은 청소년유해매체물 목록 등재의 대상이 되지 않는다고 규정함으로써 두 제도가 중복되지 않고 분리하여 운영하고 있다. 우리 법제에는 이와 같은 조항이 없기 때문에 두 제도의 관계에 대한 법해석이 필요하다. 두 제도 간에 청소년연령 기준이 일치하기 때문에 청소년 불가 등급의 매체물은 청소년유해매체물이 된다는 것이 기존의 실무관행이었다. 지금은 청소년보호법과 매체물법 간의 청소년 연령기준이 일치하지 않기 때문에 청소년유해매체물로 고시하지 않는다고 여겨졌다. 그러나 청소년보호법과 매체물법의 해석을 통해 볼 때, 특히 청소년보호법 제8조에서 청소년유해매체물이 아닌 매체물에 대해서 등급분류할 수 있다고 하기 때문에 청소년불가 등급의 매체물은 청소년유해매체물이 될 수 없다고 해야 한다. 따라서 청소년보호법과 매체물법간에 청소년연령기준이 일치한다고 해도 이와 같은 해석론에 따라 청소년 불가 등급의 매체물은 청소년유해매체물로 고시될 수 없다. 또한 이와 같은 해석론을 명확히 하기 위해서 독일 청소년보호법과 같이 등급분류제와 청소년유해매체물 제도를 구분하는 규정을 청소년보호법에 신설할 필요가 있다.

영어초록

It was introduced the “Harmful Media to Youth” influenced by German act, through the Youth Protection Act of 1997 and also introduced the “Film Classification” in same year, through the Movie Promotion Act. Because two institutions have the same mission that protects the youth from harmful media, most countries don’t carry out two institutions together, except Germany and Korea. On the German Youth Protection Act, as making the provision that the classified media don’t be registered at the “Harmful Media to Youth” list, two institutions are carried out, divided and not overlapping. Because there is no same provision in Korean legislation, it is needed the interpretation of acts about legal relation of two institutions. The existing practice is the not-permitting-to-youth rating media is the “Harmful Media to Youth”, based on the same age for youth of two institutions. Now it is considered that the not-permitting-to-youth rating media is not notified as the “Harmful Media to Youth”, because of the difference of youth age between the Youth Protection Act and media acts. But on the ground of the interpretation of the Youth Protection Act and media acts, especially the Article 8 of the Youth Protection Act, the media that is not the “Harmful Media to Youth” can be classified, the not-permitting-to-youth rating media can not be the “Harmful Media to Youth.” Therefore, when the Youth Protection Act and media acts are used the same age of youth, the not-permitting-to-youth rating media is not notified as the “Harmful Media to Youth” as the interpretation above. And for clearing up this interpretation, it is necessity to amend the Youth Protection Act same as the German Youth Protection Act.
