초록

국가와 지방자치단체의 관계는 지방정부가 중앙으로부터 상당한 독립성과 자율성을 보장받는 분권형 국가관리시스템의 구축이 선행되어야 한다. 즉 지방정부가 자신의 문제를 자율적으로 해결할 수 있는 영역을 넓혀주고 일방적인 지시와 통제에 의존하던 직접관리방식에서 탈피하여 수평적인 지원, 조언, 타협을 통한 간접관리방식으로 지방자치단체와의 관계를 정립해나가야 한다. 또한 지방자치단체에 대한 실제적 자치권의 보장은 절차적 보장으로 강화될 때 더욱 실효적인 것이 될 수 있다는 점에서, 자치권의 절차적 보장은 단지 정책적 차원의 문제가 아니라 지방자치에 관한 헌법적 보장의 핵심으로 이해되어야 할 것이다. 국가입법작용에 있어서도 지방자치를 중시하고 배려하는 입법의 원칙이 요구되는데, 국가 내지 중앙의 의도나 이해관계만이 주로 반영되어 자치권을 침해하거나 제약하는 법령들을 양산할 것이 아니라, 지방의 입장이나 고유성도 동시에 반영할 수 있도록 하고, 국가가 법률이나 법규명령을 입안․심의할 때에는 반드시 지방의 의견을 수렴하도록 하는 입법의 원칙과 절차가 요구된다.
또한 지방자치단체간의 상생과 협력관계를 정립하기 위해서는 분권화시대에 맞게 지방자치단체간 관계가 상호의존성에 바탕을 둔 협력관계로의 전환과 함께 이에 걸맞는 기존의 관행과 제도의 정비가 요청된다. 특히 환경문제로 인한 님비현상이나 지방자치단체간 갈등극복을 위해서는 보상체계의 정비, 정보공개의 내실화, 주민참여의 제도화, 기능 및 권한배분의 명확화 등 각각의 원인에 따른 적절한 대책이 마련되어야 할 것이다. 다음으로 광역자치단체와 기초자치단체간의 협력관계의 구축이 요청된다. 광역행정을 통일적으로 수행하기 위해 지도․감독이 불가피한 경우에도 비권력적 방식에 의하여야 하고 그 범위도 제한적이어야 한다.

영어초록

The relation between the nation and the local government should be preceded by the decentralized nation-management system guaranteed the local government's independence and autonomy from the central government.
In other words, the sphere which local government could solve autonomously self-problems should be enlarged, and the direct management system that has counted on the one-sided order and control should be outgrowed so that the relation between the nation with local government can be established as an indirect management system through horizontal assistance, advices and compromises.
In addition, the guarantee of substantial autonomy for the local government could be more effective when it is reinforced by procedual gurantee. So the procedual gurantee of autonomy should be understanded as not so much just policy issue as a core of constitutional gurantee about self-government.
And the principles of legislatin that attach importance and consideration to self-government schould be established in the field of national legislative process. Namely, mass producing laws infringing and restricting autonomy reflected mainly the intention or interests of a nation or central government schould not be allowed. So in time of a nation's drafting and deliberating laws and ordinances, the principles and procedure of legislation collecting local opinion are demanded so as to reflect concurrently the local stand-points or characteristics.
Besides, for the establishment of co-existence and cooperative relation among the local governments, it is necessary to convert the relation among the local governments to the cooperative relation based on the mutual reliance and to maintain existing traditional practices and institution well mated to it. Especially, to get over a NIMBY caused by environmental problems and the conflicts among the local governments, it has to be arranged to proper measure according to each causes maintaining compensatory system, making substantial the releasement of information, institutionalizationing of inhabitants participation and making clear functions and distribution of authorities .
Next, it is requested to construct the cooperative relations between a large-unit local governments and fundamental local governments. when it is inevitable to instruct and inspect fundamental local governments to accomplish unified a large-unit administration, the method schould be uninfluential and the sphere schould be restrictive.
