Ⅰ. 서론

우리나라는 2004년 3월 한-칠레 FTA 발효를 시작으로 2007년 6월 한-ASEAN FTA(상품무역협정) 발효에 이르기까지 “동시다발적 FTA 체결”이라는 정책에 따라 신속하고 지속적인 FTA 체결을 추진해 왔고 그 결과가 하나씩 나타나고 있다. 최근 들어서는 KORUS FTA에 대한 서명이 이루어졌고 현재도 EU, 인도, 캐나다 등 주요 교역국을 중심으로 FTA 협상이 진행중이다. 즉, 정부의 FTA 추진 로드맵에 따라 거점국가를 중심으로 시작됐던 FTA 체결이 주요 교역국 및 거대경제권과의 FTA 체결로 급속히 확대되고 있다.
FTA 체결시에는 무역자유화를 통한 교역규모 확대 또는 피해가 가장 큰 관심사항이 될 수밖에 없다. 따라서 FTA가 체결되기 전에는 무엇보다도 협정 상대국과의 관세철폐로 인한 교역증대 효과 또는 수입증가로 인한 국내산업 피해규모에 대한 정확한 연구가 필수적이다. 따라서 기체결된 FTA뿐만 아니라 현재 협상중인 FTA에 대해서도 이 부분에 대해 집중적으로 연구되었다.
그러나 한 가지 간과되어서는 안 되는 문제가 바로 원산지규정이라고 볼 수 있다. 즉, 앞서 언급한 FTA의 경제적 이익을 극대화하기 위해서는 협정 상대국간 원산지판정을 통해 특혜관세가 적용되고, 역외국에 대해서는 우회 수출입 금지 및 특혜관세 적용 배제 등의 조치가 이루어져야 한다. 다시 말해서, FTA를 이행하는 과정에서 실질적으로 적용되어 FTA의 효과를 극대화 하고 역외물품으로부터 산업을 보호하는 가장 핵심적인 분야가 바로 원산지규정이라고 할 수 있다. 뿐만 아니라 간접적으로는 기업의 투자 및 생산방식에 미치는 영향이라는 측면에서도 그 중요성은 상당히 크다.
따라서 FTA 체결시 모든 국가는 각국별 고유의 산업경제적 특성, 수출입 구조, 정치사회적 요인 등 이해관계에 따라 FTA별·품목별로 조금씩 다른 원산지규정을 도입하고 있다. 그러나 우리나라의 경우, 최근 들어 FTA 체결이 증가하여 원산지규정의 중요성에 대한 관심이 증가하고 있으나 FTA 협상국별 원산지규정에 대한 연구는 다소 부족하다고 판단된다.
