Ⅰ. Introduction

1. The object of the study

When it comes to the legislation of a new law, there is always a conflict in opinion between people who support it and oppose it. On the surface, those conflicts in opinion regarding each issue do not seem to have any relationship between each other. However, when we analyze what is inside those conflicts, we can find out that most of those conflicts related to legal issue have the same inner structure; that is the conflict between public welfare and individual’s right. Laws that are legislated to maintain public welfare is often criticized for its possibility to violate individual’s right. On the other hand, laws that are legislated to maximize the right of each individual are often concerned for its possibility to harm social order.
The controversy over naming and shaming is an issue which represents the inner conflict between public welfare and the individual’s right. People who support naming and shaming are aware of the fact that rights of criminals can be deprived due to the legislation of naming and shaming. However, because they believe that they can maintain public welfare, which is more important to them, by enacting naming and shaming, they advocate it. On the other hand, the opponents of this law views that an individual’s right including the criminal’s right cannot be violated because it is valuable than anything else in this society. Therefore, they oppose the legislation of naming and shaming. Thus, by studying this issue in depth, I would like to understand the core of conflicts related to legal issues; the value conflict between public welfare and individual’s right.
