초록

최근 윤석열 정부에 들어서면서 기존의 전자정부를 심화･발전시킨 개념인 이른바 ‘디지털플랫폼정부’가 국정 전략의 일환으로 추진되고 있다. 여기서 디지털플랫폼정부는 디지털 플랫폼 내에서 AI와 데이터, 클라우드컴퓨팅 등 새로운 디지털 신기술을 적용함으로써 국민들이 다양한 편익과 혜택을 누릴 수 있도록 고안된 개념으로 이해할 수 있다. 이는 민관의 협력을 전제로 한다는 점에서 정부가 주도적으로 추진해온 관주도적 정부서비스 개념과는 다소 차이가 있다.
한국은 이미 전세계적으로 최상위 수준의 전자정부 성과를 달성하였다. 이 과정에서 그간 전자정부법을 비롯한 여러 관련 입법의 시의적절한 마련이 중요한 요인으로 작용하였다고 평가할 수 있다. 특히 이윤 추구를 목표로 하지 않는 공공부문의 경우 비단 정책의 설계와 추진만으로는 자발적인 실행력을 기대하기 어려운 측면이 있어 입법의 기능과 역할이 그만큼 중요하다. 따라서 디지털플랫폼정부의 실현에 있어서도 구체적인 이행력을 확보하고, 효율적이고 체계적인 추진을 위해서는 세밀한 입법전략이 필요하다.
그런데 그간 행정정보 공동이용과 전자민원서비스를 중심으로 한 전자정부 법제는 공급 정책의 일환에서 전자정부서비스를 확대하고 그 저변을 넓히는데 방점을 두어왔다. 이에 따라 현행법은 수범자인 공적 주체들이 행정업무나 공공데이터 공개･활용 정책 등을 실행하는 데 있어서 유념해야 할 기본원칙과 절차적 근거를 마련하는 것에 많은 부분을 할애하고 있다. 맞춤형 정부서비스를 제공해야 하는 디지털플랫폼정부의 개념 하에서는 기관별, 업무 단위별로 분산되어 규율하고 있는 기존 법체계를 일부 수정할 필요성이 있다. 즉, 정부서비스의 연계성 강화에 방점을 둠으로써 데이터, 지능형 AI 등 필수 자원의 공유와 활용을 수요 중심으로 추동하는 방향으로 규율체계를 정립하여야 한다는 것이다.
이에 본 연구는 디지털플랫폼정부서비스의 연계 및 통합을 활성화하기 위한 입법 방안을 핵심적으로 제안하였다. 특히 기존에 행정망 구축과 대국민 행정서비스를 통합적으로 규율해 온 전자정부법이나 공공기관의 공공데이터 공개 및 개방에 관한 원칙을 규정하는 공공데이터법, 그리고 행정의 과학화를 위한 행정정보의 집적과 분석･활용에 대하여 정하고 있는 데이터기반행정법 등은 분산되어 있는 개별 정부서비스 간의 연계와 통합의 관점이 내재화 되어 있지 않기 때문에 특별법적 성격의 법률을 제정하는 것이 보다 타당하다고 보았다. 이와 같은 형식의 입법 추진을 통해 디지털플랫폼정부서비스가 단발적인 정책 모델에 그치지 아니하고, 지속적으로 정부서비스 분야에 혁신을 불러올 수 있는 모델로 발전할 수 있기를 기대한다.

영어초록

Recently, the so-called ‘Digital Platform Government’, a concept that deepened and developed the existing e-government, is being promoted as part of the national strategy. Here, the digital platform government can be understood as a concept designed to enable the people to enjoy various benefits and benefits by applying new digital technologies such as AI, data, and cloud computing within a digital platform. This is somewhat different from the so-called e-Government service concept, which was previously centered on the government, in that it actively promotes cooperation between the private sector and the government.
Korea has already achieved a high level of e-Government performance by supporting efficient policy execution and systematic operation through preemptive preparation of various related legislations, including the e-Government Act. In particular, in the case of the public sector, which does not aim at profit, the role of legislation is important because it is difficult to strengthen executive power and achieve sustainable development only by designing and promoting policies. Therefore, it will be said that a detailed legislative strategy is important in order to secure concrete performance and promote efficient and systematic implementation in the realization of Digital Platform Government. In this regard, this study legislatively fulfilled the legislative tasks related to the Digital Platform Government in the process of establishing a standard API (Application Programming Interface) transmission system corresponding to the core infrastructure that is the basis of the Digital Platform Government service concept and linking and integrating it. I focused on the main issues that need to be addressed.
However, innovative changes to prediction-based administrative processes through the latest digital technologies such as AI, data, and cloud computing inevitably face a collision with the existing standardized administrative system. The e-Government Act, which has been integrating the existing administrative network establishment and public administrative services, and the Public Data Act, which stipulates the principles of public data disclosure and opening by public institutions, and the accumulation, analysis, and utilization of administrative information for scientification of administration This is because the Data-Based Administrative Act, etc., stipulated against, does not internalize the point of view of linkage and integration among dispersed individual government services.
In this article, it is argued that through the enactment of new legislation in the form of a special law, it can contribute to the continuous development of innovative government services, not just a one-off policy model. To this end, it was argued that a detailed strategy is needed to clearly design the purpose of the new legislation and to standardize it accordingly. If this purpose is included in the new legislation regulating the provision and operation of Digital Platform Government services, it will create innovative changes in innovative government services based on private cooperation without causing great confusion in matters governing government services under individual laws. It is expected that it can function as a legislative basis that can be implemented.
