무형문화재법 관련 판소리 전승 현황과 제도 연구 (A Study on the Transmission and System of Pansori related to Intangible Cultural Asset Laws)

초록

그간 무형문화재 보호제도는 성과만큼이나 개선해야 할 많은 과제를 지니고 있었다. 과거 무형문화재는 역사성, 학술성, 예술성, 향토성을 기준으로 종목이 지정되었다. 이와 동시에 해당 무형문화재의 기능이나 예능을 원형대로 체득, 보존하여 그대로 실현할 수 있는 사람을 보유자로 인정하여 전승자를 양성하였다. 정부는 2016년부터 유네스코 협약과 무형문화유산의 질적 보호, 국제교류협력과 확산 등을 위해 ‘무형문화재 보전 및 진흥에 관한 법률’(약칭 ‘무형문화재법’)을 제정하고 시행하고 있다.
본고는 무형문화재법의 시행과 관련하여 현재 국가무형문화재 보유자의 현황과 전승, 새로 시행되는 무형문화재법의 특징들을 살펴봄으로써 향후 판소리 보전, 전승의 향방을 제시하는 데 목적이 있다. 이를 위해 현재 국가무형문화재 보유자들 7명의 전승 현황을 살피고, 새로 제정된 법률안의 특징을 고찰하는 동시에 무형문화재 지정 심의와 평가 세부내용을 살펴보았다.
현재의 판소리는 문화재로 지정되는 유파는 보호, 육성되지만 거기에서 소외되는 유파는 몰락할 수밖에 없는 구조를 가지고 있다. 지정의 영역에서 벗어나 있으면서도 충분히 기량과 실력을 갖춘 명창이 있고, 그 아래서 제자들이 양성되기도 한다. 그런데 이와 같은 전승에는 일정한 한계가 있기 때문에 연구자들이 이러한 명창을 지속적으로 발굴, 연구, 보호해주어야 할 책무가 있다. 법률이나 제도가 실상을 반영하면서 판소리 보호, 육성, 재창조를 이끌어 줄 때 현장의 소리꾼들이 세계문화유산을 지키고 계승해 나갈 수 있을 것이기 때문이다. 당장은 유파별 계승을 담당할 보유자들의 저변이 넓어져야 하고, 지역의 명창들이 그 명성에 걸맞는 보유자 지정을 받을 수 있도록 관계자들의 노력이 필요할 것이다.

영어초록

The existing protection system of intangible cultural assets has not only provided for many positive results, but also issued for an appropriate law system. The past items that constitute the intangible cultural assets was designated according to historicity, scholarship, artistry, and local features. Meanwhile, transmitters was trained by acknowledging holders who can learn, preserve, and realize the functions or artistic talents of the relevant intangible cultural assets. To implement the UNESCO Convention, the qualitative protection of intangible cultural heritages, and the cooperation and spread of international exchanges, the government has enforced the “Intangible Cultural Assets Preservation & Promotion Act (‘Intangible Cultural Assets Act’)” since 2016.
In relation to the enforcement of this Act, this paper’s aim is to suggest future directions for preserving and transmitting Pansori, by examining the current status and transmission of intangible cultural asset holders, and also the characteristics of the newly enforced Intangible Cultural Assets Act. By reviewing the current status of the national cultural asset holders, and considering the characteristics of the newly established legislative bill, the study examines the deliberations and evaluations required to designate intangible cultural assets.
In case of the current Pansori, the school designated as a cultural asset is protected and promoted while other alienated schools collapse. There are master singers equipped with great skills and abilities, who foster disciples while remaining external to the school. Because such transmission has certain limitations, however, researchers are responsible for continuously discovering, researching, and protecting such master singers. When regulations or systems reflect the reality involved in leading the protection, promotion, and recreation of Pansori, singers in different sites can protect and carry on the world’s cultural heritage. Right now, the base of holders(master singers) in each school charged with maintaining and preserving Pansori should be expanded. It is also necessary that interested persons should increase efforts to designate local master singers as holders in ways appropriate to their fame.
