초록

본 논문은 생성형 인공지능(Generative AI)의 급속한 확산으로 변화하고 있는 창작 환경 속에서, 프롬프트(prompt)의 법적 성격과 저작권 보호 가능성에 대해 다각적으로 고찰하였다. 프롬프트는 단순한 명령어 입력을 넘어 창작자의 기획 의도와 감성을 반영하며, 생성 결과물의 주제, 구성, 스타일 등에 실질적인 영향을 미치는 창작 행위로 기능하고 있다. 이에 따라 기존 저작권법상 ‘창작성’ 개념에 대한 재해석과 함께, 결과물 중심의 판단에서 벗어나 창작 과정이나 인간의 기여도를 반영하는 ‘과정 중심’ 또는 ‘기여 중심’ 평가 방식으로의 전환 필요성이 제기되고 있다. 이와 관련하여 본 논문에서는 프롬프트가 공동저작물 또는 편집저작물로 보호될 수 있는 가능성에 주목하고, 프롬프트 입력이 단순한 기계 조작을 넘어 실질적인 창작적 기여로 인정될 수 있는지 여부를 검토하였다. 이를 통해 창작성 판단 기준의 재정립과 더불어, 프롬프트 작성자를 저작권법상 ‘저작자’로 인정할 수 있을지에 대한 논의를 전개하였다. 또한 프롬프트가 컴퓨터프로그램저작물 또는 데이터베이스로 보호될 수 있는지에 대해서도 분석하였으며, 일반적인 프롬프트가 자연어 기반의 비결정적 지시문으로서 기술적·구조적 한계를 가진다는 점에서, 현행 저작권법이 요구하는 보호 요건을 충족하기 어렵다는 점을 지적하였다. 다만 최근 등장한 복합 프롬프트(complex prompts)의 경우, 논리적 구조와 반복 가능성을 갖추고 있어, 향후 기술 발전에 따라 편집저작물 또는 데이터베이스로 재평가될 수 있는 가능성도 함께 제시하였다. 아울러 프롬프트 보호를 위한 입법적 대응 방안과 관련하여, 별도의 독립 법률을 신설하기보다는 기존 저작권법 내 정의조항 및 저작물 유형 규정을 확장하는 방식이 보다 안정적이고 현실적인 대안이 될 수 있음을 제안하였다. 이를 위해 ‘프롬프트 기반 저작물’, ‘AI 디렉터’와 같은 개념을 도입하고, 창작성 판단 기준을 보완하는 다층적 제도 설계가 함께 마련되어야 함을 강조하였다. AI 프롬프트는 인간의 창의적 기획과 표현 의도가 반영된 새로운 형태의 창작 매개체로서, 저작권법상 보호가 가능한 독립적인 창작 행위로 평가되는 것이 합리적이다. 따라서 프롬프트에 대한 법적 평가와 제도적 수용은 생성형 AI 시대의 창작 생태계에서 창작자의 권익을 보호하고, 법적 안정성을 확보하기 위한 핵심 과제가 될 것이다.

영어초록

This paper examines the legal nature of prompts and the possibility of copyright protection in a creative environment that is changing due to the rapid spread of generative AI. Prompts go beyond simple command input and reflect the creator’s planning intention and emotion, and function as creative acts that have a substantial impact on the subject, composition, and style of the generated results. Accordingly, the need to reinterpret the concept of ‘creativity’ under the existing copyright law and shift from a judgment centered on results to a ‘process-centered’ or ‘contribution-centered’ evaluation method that reflects the creative process or human contribution is being raised. In relation to this, this paper focuses on the possibility that prompts can be protected as joint works or edited works, and examines whether prompt input can be recognized as a substantial creative contribution beyond simple machine operation. Through this, in addition to the reestablishment of criteria for judging creativity, a discussion is conducted on whether the prompt writer can be recognized as an ‘author’ under the copyright law. In addition, it analyzed whether prompts can be protected as computer program works or databases, and pointed out that general prompts have technical and structural limitations as non-deterministic instructions based on natural language, making it difficult to meet the protection requirements of the current copyright law. However, in the case of recently emerged complex prompts, it was suggested that they have a logical structure and repeatability, and thus may be re-evaluated as edited works or databases in the future as technological developments advance. In addition, regarding legislative measures for prompt protection, it was suggested that expanding the definition provisions and types of works in the existing copyright law rather than establishing a separate independent law could be a more stable and realistic alternative. To this end, it was emphasized that a multi-layered system design should be established to introduce concepts such as ‘prompt-based works’ and ‘AI directors’ and supplement the criteria for judging creativity. It is reasonable to evaluate AI prompts as a new form of creative medium that reflects human creative planning and expressive intent, and as an independent creative act that can be protected under the copyright law. Therefore, legal evaluation and institutional acceptance of prompts will be key tasks for protecting the rights of creators and securing legal stability in the creative ecosystem of the generative AI era.
