[4] 지방자치법에 근거한 행정체제의 정비가 중요하다. 우리의 통일 과정에서 통일 헌법 제정 시, 그 헌법에는 반드시 지방분권에 관한 문언 및 내용이 포함되어야 한다. 그리고 이러한 분권적 헌법의 가치를 구현할 지방자치법의 제정 역시 필수적으로 따라야 할 것이다. 통일한국의 초기에는 지방자치보다는 중앙집권적 경제성장을 강조할 여지가 크지만, 중앙집권 후에 따르게 될 지역 불균형의 문제와 주민 삶의 질적 보장을 고려하면, 애초 제도 설계 시에 집권보다는 분권적 국정 운영 체제를 확보하는 것이 중요하다.
[5] 지방자치의 시행 시기에 관하여. 필자는 과거 지방자치의 궁극적인 목적인 주민의 복리 증진과 기본권 보장을 위해서라도 통일 후 곧바로 지방자치의 실시를 주장하였다. 여기에 다른 이유를 더 한다면, 지방자치제의 시행을 염두에 둔 잠정적인 연기보다는, 시행착오를 줄이기 위한 철저한 준비와 검증을 통하여 통일헌법에서 지방자치의 실시를 명시하고, 그 구체화로서 지방자치법을 제정하여 통일과 동시에 지방자치를 실시하는 것이 옳다고 본다.
[6] 분권적 행정체제로의 개편의 필요성이다. 통일 과정에 있어 북한의 지역 사정을 무시하고 일괄적이고 중앙집권적인 지방행정체제의 선택은 자칫 지역민과 각 지방의 반발을 초래하여 큰 소요로까지 이어질 수도 있음을 명심해야 한다. 새로운 지역감정과 지역균형개발의 문제를 사전에 차단할 수 있는 행정체제의 개편이 필요한 이유이다. 이를 위해 필요한 것이 바로 지방분권적 지방행정체제로의 개편이라고 할 것이다. 이와 함께 헌법적 차원에서의 지방분권적 정치제도의 구현(개헌)도 함께 논의되어야 한다.
[7] 지방행정체제개편을 위한 특별법 및 선거제도의 정비가 필요하다. 통일 이후 북한의 지방행정체제개편 문제에 앞서 선행되어야 할 과제가 바로 지방행정체제개편을 위한 특별법 등 법률의 정비이다. 또한 북한의 지방행정체제의 완성은 직업적으로 전문적인 공무원제도가 북한에 정착하는 것을 전제로 한다. 무엇보다 공무원 조직이 민주적 법치국가 하의 조직으로 재탄생되어야 할 것이다.
[8] 북한지역 행정체제의 선별적 수용도 필요하다. 통일 후 자강도는 평안북도에, 양강도는 함경북도에 병합시켜 해방 후 지방행정구역의 수와 유사하게 전국을 14도(평안남도, 평안북도, 함경남도, 함경북도, 황해도, 강원도, 경기도, 충청북도, 충정남도, 전라북도, 전라남도, 경상북도, 경상남도, 제주도)로 개편하여야 한다. 이는 남북한 분단 이전의 지방행정구역으로 환원하는 것으로 지방행정구역 통합에 있어서 혼란과 비용을 줄이고, 역사적 정체성을 되찾는 일이기도 하다. 또한 통일 후의 경제개발은 특구를 이용하게 될 가능성이 크다. 이러한 특구의 역할과 운영은 통일 과정에서 그대로 살릴 필요가 있을 것이다.

[1] First, it is about the unified constitution. In order to get ready for exhausting political strife by the lack of constitutional contents about unification, and also to reorganize the efficient and resident-friendly local administration system, it is required to enact the unified constitution. In the perspective of local administration system, it is necessary to have the unified constitution reflecting at least two types of contents. First, the constitution should have the concrete contents about the method of unification. Second, the constitution should decide the frame of local administration system in the unified Korea. This frame should contain the contents about local government system based on the decentralization.
[2] It is an issue related to the federal system as the national identity. If the unified Korea selects the federalism and then establishes the local administration system, it would be worth to consider the Canadian federal system that has relatively greater roles of provinces compared to the federal government of the United States. It would be advisable not only to accept the superiority of central government as a representative government of the state, but also to take the strategic cohabitation that clearly acknowledges the identity and subsidiarity of local governments.
[3] It is the necessity of legal integration between South and North Korea. In the concrete stage of unification, the issue of legal integration is the core contents of unification. What is important here is how to reflect the unique characteristics of North Korea into the process of legal integration or legal succession, and how to form the legal system based on the democratic basic order. In this perspective, the reorganization of North Korean local administration system and the implementation of local government system could be the best plans for legal assimilation, and also great tools for the faithful reflection of public opinions.
[4] The reorganization of administration system based on the Local Government Act is important. In case when the unified constitution is enacted in the process of unification, the constitution should include words and contents about decentralization of power. And it would be also essential to enact the Local Government Act that could realize the value of this decentralized constitution.
[5] It is about the time to implement the local government system. Instead of tentative postponement keeping the implementation of local government system in mind, it would be better to clearly specify the local government system in the unified constitution through thorough preparation and verification to reduce trials and errors, and then to implement the local government system simultaneously with the unification by enacting the Local Government Act as its materialization.
[6] It is the necessity of restructuring into the decentralized administration system. In the process of unification, the selection of comprehensive and centralized local government system without considering the regional conditions of North Korea could be led to huge disorders by causing the resistance of local residents and each region. This is the reason why it would be needed to reorganize the administration system that could prevent the problems like new regionalism and balanced regional development.
[7] It is required to reorganize a special law and election system for restructuring the local administration system. The reorganization of laws such as a special law for restructuring the local administration system is the task that should be preceded before restructuring the local administration system in North Korea after the unification. Also, the completion of local administration system in North Korea is subject to the fact that the professional civil service system is vocationally settled down in North Korea. Above all, the civil service should be reborn as an organization under a democratic constitutional state.
[8] The selective acceptance of North Korean administration system would be also needed. After the unification, the whole nation should be restructured into total 14 dos(Pyeongannam-do, Pyeonganbuk-do, Hamgyeongnam-do, Hamgyeongbuk-do, Hwanghae-do, Gangwon-do, Gyeonggi-do, Chungcheongbuk-do, Chungcheongnam-do, Jeollabuk-do, Jeollanam-do, Gyeongsangbuk-do, Gyeongsangnam-do, Jeju-do) similar to the number of local administrative districts after the liberation by annexing Jagang-do to Pyeonganbuk-do and Yanggang-do to Hamgyeongbuk-do after the unification. Moreover, it would be necessary to allocate the administrative authority and also to settle down the professional civil service system.
