前漢初 中尉의 권력화 현상 (The Phenomenon of Power Consolidation by the Zhongwei(中尉) in the Early Western Han Period)

초록

본고는 前漢初 中尉의 권한을 분석하며 권력화 경향을 논의하였다. 먼저 中尉는 여러 都官계통의 佐·史를 임명할 수 있을 뿐만 아니라, 경우에 따라 卒長·五百將·候長이나 官佐·史 등을 차출하여 전근시킬 수 있는 것으로 추측했다. 이는 秦代에 비해 확대된 中尉의 권한을 보여준다. 또한 秩 600石이상 고급 軍吏의 인선 과정에서 中尉는 擇人權을 가지고 있다. 中尉는 그 자체로 장군은 아니며, 장군보다 동원할 수 있는 인원 종류와 규모는 제한되어 있다. 그러나 예하 정규부대를 두고 이를 통솔할 수 있었기 때문에, 장군에 비견하는 권력을 가졌다. 이에 內史의 권한만으로는 京師지역내 中尉의 권력화를 견제하기 어려웠다. 「二年律令」의 규정에 따르면 尉계통은 治獄權을 가지고 있지 않지만, 실제로는 中尉가 각종 사법 행위를 통해 宗室 및 豪族을 압박하며 권력화되었다. 武帝시기에 이르러 執金吾로 개칭되며 권한은 축소되는데, 이는 軍官을 통해 황제 권력을 보호하는 의도는 줄곧 관철하되, 특정 軍官의 권력화는 막은 조치이다. 아울러 中尉의 개칭을 통해 중앙 朝廷과 제후국 사이 상이한 官制 변화의 흐름을 유추할 수 있다.

영어초록

This paper analyzes the authority of the Zhongwei (中尉) during the early Western Han period and discusses its tendencies toward power consolidation. First, it is presumed that the Zhongwei could appoint various assistants and scribes (佐･史) within the hierarchical systems of the capital offices and, in certain cases, transfer or reassign officials such as company commanders (卒長), commanders of five hundred (五百將), troop supervisors (候長), and other administrative assistants and scribes. This all demonstrates the expanded authority of the Zhongwei compared to the Qin dynasty. Furthermore, in the selection process of high-ranking military officials with stipends of 600 dan (石) or more, the Zhongwei (中尉) held the authority to select personnel (擇人權). The Zhongwei was not a general per se, and the types and scale of personnel he could mobilize were more limited than those of a general. However, since he commanded regular subordinate troops and could lead them, he held authority comparable to that of a general. Thus, it was challenging to restrain the Zhongwei’s growing power within the capital area solely with the authority of the Neishi (內史). According to the provisions of the “Ernian Lüling”(二年律令), the Wei (尉) system did not possess the authority to administer criminal cases. However, in practice, the Zhongwei gained power by exerting pressure on the royal family (宗室) and powerful families (豪族) through various judicial actions. By the time of Emperor Wu, the title was changed to Zhijinwu (執金吾), and its authority was weakened. This change reflects an intent to consistently protect imperial power through military officials while preventing the consolidation of power by any specific military official. Additionally, the renaming of the Zhongwei allows us to infer the differing trends in official systems between the Han dynasty court and the feudal states.
