해양경찰청의 소속 부처 결정 방향 (A Study on the Direction for Determining the Department(ministry) to Which the Korea Coast Guard belongs)

초록

해양경찰 조직의 소속은 1953년 창설 때부터 현재에 이르기까지 내무부 → 상공부→ 내무부→ 경찰청→ 해양수산부→ 국토해양부→ 해양수산부→ 국민안전처→ 해양수산부로 변경이 자주 있었고, 조직개편 시마다 해양경찰을 어느 부처에 소속시키는 것이 타당한지에 대한 논란이 적지 않았다. 2017년 해양경찰청으로 환원시키는 과정에서 해양경찰청이 안전부처 소속 외청이 되어야 한다는 주장과 해양수산부 외청이 되어야 한다는 주장이 첨예하게 대립되었지만 결국 2017년 정부조직개편에서 해양경찰청은 해양수산부의 외청이 되었다. 이러한 조직개편이 바람직한 결정이었는지 살펴보는 것은 큰 의미가 있다고 생각된다. 조직개편은 정치적 논리나부처의 적정한 규모 관점에서 이루어지기 보다는 합리적인 논리와 근거에 의하여결정되어야 할 것이다. 향후 정부조직개편에서 해양경찰청이 어느 부처 소속이 되어야 하는지 신중한 검토가 있어야 할 것이다. 본 논문에서는 국회 안전행정위 회의록, 정부조직법 개정법률안 등을 분석하고, 해양경찰과 해양수산부의 직제시행규칙을 비교·분석하였다.
결론적으로 ➀ 해양경찰청은 안전부처 소속 외청이 되는 것이 타당하며, 해양경찰청이 해양수산부 외청이 되어야 한다는 주장의 핵심 논리인 해양경찰과 해양수산부와의 업무 관련성이 50%이상이어서 시너지 효과를 낼 수 있다는 주장은 설득력이떨어진다는 것이다. ➁ 해양경찰청의 소속은 해양수산부 유무와 관계없이 해양경찰이 수행하고 있는 기능과 역할을 고려하여 합리적으로 결정되어야 한다는 점이다.

영어초록

Since its early foundation in 1953, the Korea Coast Guard(KCG) has encountered numerous changes: from being under the ‘Ministry of Trade Industry and Energy’ → ‘Ministry of Internal Affairs’ → ‘Agency affiliated with the National Police Agency’ → ‘External agency of the Ministry of Oceans and Fisheries’ → ‘External agency of the Ministry of Land Transport and Maritime Affairs’ → ‘External agency of the Ministry of Oceans and Fisheries’ → ‘KCG Headquarters under the Ministry of Public Safety and Security’ → ‘External agency of the Ministry of Oceans and Fisheries’ due to government reorganization. These changes have caused constant controversy over which ministry it is appropriate to organize the KCG However, during the process of returning the KCG to an external agency of the Ministry of Oceans and Fisheries from the KCG Headquarters under the Ministry of Public Safety and Security, there was a sharp conflict between the argument that the KCG should belong to the Ministry of Safety and the argument that it should be an external agency of the Ministry of Oceans and Fisheries.
Analyzing the arguments and core logic claimed at this time, it will be able to obtain implications for which ministries the KCG should be the external affairs in the future government reorganization. With this background and awareness of the problem, the minutes of the 2017 National Assembly’s Security and Public Administration Committee and the revised bill of the Government Organization Act were analyzed, and the organizational enforcement rules of the KCG the Ministry of Oceans and Fisheries were also compared and analyzed.
The conclusion obtained through these studies as follows: First, it is reasonable for the KCG to become an external agency belonging to the Ministry of Safety. Second, the argument that synergy can be created due to the work relationship between the KCG and the Ministry of Oceans and Fisheries is more than 50 percent, which is the core logic of the argument that the KCG should become and external agency of the Ministry of Oceans and Fisheries, is not convincing. Third, the affiliation of the KCG should be determined independently in consideration of the functions and roles performed by the KCG, regardless of the presence or absence of the Ministry of Oceans and Fisheries.
