초록

우리나라의 자치경찰제도가 「제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법」이 제정․공포되고서 2006년 7월 1일 우리나라에 도입된 이래 2년이 가까이 지났다. ‘주민생활중심의 자치경찰제’로서의 도입을 표방하고 제주특별자치도의 발족과 더불어 출범한 자치경찰은 이제 전국에 전면적으로 도입하고자 그 시기를 저울질하고 있다.
해방이후 우리나라 경찰제도의 발자취를 돌이켜 보면 많은 굴곡의 역사를 가지고 있음은 주비의 사실이다. 1945년 우리나라의 광복과 함께 독립이 되기 이전에 미군정이라는 과도기를 거쳤고, 이후 6.25남북분단의 전쟁과 이승만 정권 이후의 여러 권위주의적 정권을 거치면서 필연적으로 발생한 민주화의 우여곡절을 지나오는 과정에서 경찰제도는 시종일관 대륙법계의 중앙집권적 경찰제도를 유지하였다.
그동안의 경찰의 조직은 시대적인 상황에 따라 변천을 거듭하여 미군정하에서 경무부시대를 거쳐 1948년 정부수립 이후의 치안국 시대, 1974년 치안본부 시대, 1991년 경찰청 시대를 거치게 되었음에도 국가경찰제도라는 기본 틀을 그대로 지켜온 것이다.
그러나, 국가성립 초기의 국정의 안정적 운영과 질서유지라는 경찰의 책무에 따르는 현실적인 필요가 국가 경찰제도의 존치라는 대의 명분을 유지시켜주기는 하였지만, 이제 국가경찰제도로는 민주화와 지방분권 시대에 지역주민의 민의를 충분히 반영하지 못하므로, 지방자치의 효율성 측면에서도 자치경찰제도가 도입되어야한다는 공감대가 폭넓게 전개되고 있다.
브라이스(J. Bryce)는 “지방자치는 민주주의의 가장 좋은 학교(the best school of democracy)이며, 민주주의 성공을 위한 가장 최선의 보장(the best guarantee)”이라고 하였다. 우리나라도 본격적인 민주주의 시대를 맞아 1995년 지방자치시대가 시작되었다. 지방분권의 시대에 지방자치의 틀 안에서 자치경찰제의 도입연구가 활발하게 진행되고 있다. 이러한 움직임은 자치단체의 집행력의 강화와 주민의 기대에 부응하는 종합행정의 필요성이라는 현실적인 이유로 자치경찰의 도입이 이루어지고 있다.
소고에서는 자치경찰의 논의의 대상을 제주자치경찰을 중심으로 전개되는 자치경찰의 운용실태를 분석하고 이에 대한 개선방안을 다루는 것에 한걸음 더 나아가, 지방자치단체의 주요부서에서 운용하고 있는 특별사법경찰제도를 자치경찰제도의 한축으로 이해함으로써, 보다 자치경찰제도의 논의를 “경찰”이라고 불리는 조직의 명칭에 연연함이 없이 경찰작용이라는 성격과 내용의 면을 고려함으로써 현실에 부합하는 자치경찰제도의 모델을 창출하고자 시도하였다.
논의를 전개하기 위하여 지방자치와 경찰행정의 관련성을 기본적으로 언급하고, 경찰 개념을 실질적 의미의 경찰과 형식적 의미의 경찰에 따라 분류하고, 행정경찰과 사법경찰의 직무를 현행법제와 관련하여 살펴본 다음, 실질적 의미의 자치경찰법제를 연구함에 있어 경찰의 조직과 제도 그리고 직무의 성질과 내용을 아울러 살펴보는 새로운 관점을 택하였다.
현행 자치경찰제도의 운용실태를 제주특별자치도를 중심으로 살펴보고, 실질적 의미의 경찰작용에 해당하는 특별사법경찰작용을 서울특별시를 중심으로 정리하였다. 이러한 제주자치경찰과 서울특별시의 특별사법경찰 제도에 대한 실태분석을 바탕으로 현행 자치경찰제도의 문제점 및 개선방향을 도출하여, 정책제언을 하는 것으로 마무리 하였다.

영어초록

It has been two years since Korea accepted the self-governing police system in July 1st in 2006 after establishing and promulgating a law for 「Establishment of Jeju special self-governing province and special law on making a free international city」. Self-governing police started its great duty for an introduction of 'self-governing police system focused on everyday lives of residents' along with an inauguration of Jeju special self-governing province. Now they are trying to take a favorable time to introduce a self-governing police law all over the nation.
It is true that Korea has much twisted history in a police system after the independence. We were in a time of transition under the military government by America before the independence in 1945 and had many twists and turns to establish democracy under the Korean war and authoritarianism. With these situations, Korea kept the centralized police system all the time based on a continental law.
Korea holds a state police system even we undergo changes in police system; police administration department by American military government, public security system after the form of Korean government in 1948, headquarters of national policy period, and national policy agency period in 1991.
A state police system in the early government had a good reason to keep its organization under the name of conducting state affairs, making the society orderly. The present day, however, it can't reflect public opinion enough in democracy and decentralization system era. That's why people express sympathy with the self-governing police system to raise the efficiency of local self-government.
J. Bryce suggested that local self-government is the best guarantee as well as the best school of democracy. Korea started to run a local self-government with earnest democracy in 1995. An introduction of a self-governing police system within the frame of local self-government in the local self-government era is under discussion. They who insist on introducing a local self-government cite such reasons, building up the conduct power, having necessities on general administration to meet the residents' expectation.
In the following, I investigated the actual working conditions of a self-governing police system based on the Jeju self-governing police, and suggested a remedy. Moreover, I regarded a special judicial police system, performed by a local self-government, as part of a self-governing police system. This doesn't limit a self-governing policy system only to a 'police' but extends to a police operation such as aspects or contents. Then, I tried to go through the ultimate goal of making a model of self-governing police system which is perfect in the current situation.
To begin a discussion I mentioned the relation between local self-government and police administration, classified the notion of police with the real and formal aspect, looked into the role of administrative and judicial police under the present law. And then I took a new angle on the police organization and system, characteristics and contents of police officers in investigating the real value of self-governing police law.
I searched the actual working conditions of a self-governing police system on the basis of the Jeju special self-governing province and special judicial police operation, came under the real police operation, on the basis of Seoul. After looking over the actual conditions on the Jeju self-governing police system and Seoul special judicial police system, I finalized the discussion giving problems, solutions, and proposals to the current self-governing police system.
