해외 주요 국가의 영화산업 구조와제도로부터의 정책적 시사점: 수직계열화와 배급 및 상영시장의 집중도를 중심으로 (Policy Implications from Film Industry Structure and System in Overseas Countries: Focusing on the Vertical Integration Structure and the Concentration of Distribution and Screening Markets)

본 고는 해외 주요 5개 국가의 영화산업 수직결합 구조와 배급 및 상영시장의 집중도를 살펴보고, 시장의 공정성과 다양성을 확보하기 위한 각국의 정책방안을 고찰하였다. 이를 통해 다음의 정책적 시사점을 도출하였다. 첫째, 국내 영화산업에서 수직계열화를 해체하여 배급업과 상영업의 겸영을 금지하는 방안에 대해서는 신중한 접근이 필요하다. 해외 국가의 영화산업 구조와 집중도를 검토한 결과, 배급과 상영부문의 결합 여부와 각 부문의 독과점 수준 사이의 연관성은 낮은 것으로 파악되었다. 또한, 해외 국가에서 이와 같은 구조규제를 법제화한 사례가 없고, 파라마운트 판례로 겸영을 금지한 미국도 사실상 수직결합을 재허용하고 있다. 둘째, 프랑스의 영화배정편성계약과 같은 제도의 도입을 검토할 수 있다. 스크린 독과점 현상과 상영시장의 집중도를 완화를 위해서는 멀티플렉스가 대작 영화를 과다 편성하는 현상에 대한 규제정책 등이 필요하다. 셋째, 프랑스의 영화조정관제도나 영국의 영화불만조정위원회와 유사한 제도를 신설하여 영화시장의 분쟁을 조정 및 중재하는 노력을 확대할 수 있다. 넷째, 영화시장의 불공정행위에 대한 행태조사를 강화하여 공정경쟁환경을 조성해야 한다.

영어초록

This research examines the policy of each country to ensure the fairness and diversity of the movie market through case studies on the vertical structure of the film industry and the concentration of distribution and screening markets in five major foreign countries. This study finds following policy implications. First, there has been a proposal on revision of relevant law to dismantle and to ban the vertical integration between distributors and cinema owners in the Korean film industry but a careful approach is needed. As a result of examining the structure and concentration of the movie industry in foreign countries, the study shows that the correlation between the level of monopoly and the vertical integration of distribution and screening was weak. This research also shows there has been no precedent to prohibit the vertical integration itself by law. The Paramount decision, the landmark United States Supreme Court antitrust case that decided the fate of movie studios in the United States film industry, seems to in fact lose effect. Second, nevertheless, it is necessary to regulate the multiplex cinema’s current practice to alleviate the screen monopoly and the concentration of screening market. In a bid to do, we could consider adopting foreign systems such as the ‘programming commitments(engagements de programmation)’, an agreement between the distributors and cinema owners in the French film industry. Third, we could expand efforts to mediate disputes in the movie industry by adopting mediation system such as ‘mediator of cinema(Médiateur du cinéma)’ in France or the film complaints panel in the United Kingdom. Finally, we need to strengthen efforts to investigate the unfair behavior of the movie market and make efforts to create a fair environment.
