초록

한국의 사회복지사 제도는 사회복지사업법에 의한 사회복지사 양성 교육과 자격증 제도를통하여 발전하여 왔다. 이러한 사회복지전문직의 제도적 속성은 사회복지사업법, 사회복지사법, 사회복지서비스 개별 법률에서 전문직으로서의 자격과 의무, 교육체계, 교육과 훈련, 전문가 단체, 채용과 지위향상 등을 명시하여 제 학자들이 제시한 전문직 요건을 규율하고 있다.
본 연구를 통하여 제도적 속성에 따른 사회복지전문직의 자격과 법적 의무, 전문직으로서의자율성과 재량행위의 특성을 고찰한 바, 도출된 함의에 따른 한국 사회복지전문직 활동의 신장과 정체성 제고의 방향은, 첫째, “사회복지사”에 대한 구체적인 법적 정의가 필요하다. 사회복지사의 법적 정의에는사회복지법령이 정한 전문가 자격을 갖춘 사람으로, 사회복지전공 영역의 교육과정을 이수하고 특정 분야에서 실습과 수련 및 경력을 갖추도록 하는 세부 규정을 마련해야 한다.
둘째, 사회복지전문직의 자율성과 재량권 발휘는, 정부조직법, 사회복지 관련 법률, 행정권한의 위임 및 위탁에 관한 규정에 따른 권한과 재량 및 전문가 윤리의 관점에서 이해되어야 한다.
따라서 사회복지전문직의 재량권 보호를 위한 민간위탁에 관한 특별법 제정이 필요하다.
셋째, 사회복지전문직의 지위와 경력관리를 위한 법제적 지원이 필요하다. 사회복지전문직의 전문가적 지위를 관리하는 처우 문제는 국가와 지방자치단체의 책무이며 사회복지사들의복지 확대 역시 전문직으로서 지위와 정체성을 강화시킬 수 있는 요인이 되므로, 사회복지사업법, 사회복지사법 등에 의한 사회복지전문직의 지위 향상과 국민 복지서비스의 질을 높이는방향으로 추진되어야 한다.
넷째, 사회복지사의 전문가적 역량 교육을 위한 법정 필수교과목의 확대로 전문성 신장을위한 사회복지사 자격제도의 재편이 요구된다. 따라서 제네럴리스트 및 스페셜리스트 양성에필요한 교과목 재편이 필요하며 사회복지사업법상 “사회복지수퍼비젼 수행”의 의무조항을 신설하고 사회복지현장실습 심화 교육과정을 도입하여 전문가적 자율성의 이해에 기반한 실천역량을 강화해야 한다.
다섯째, 사회복지사 제도의 실효성 확대를 위한 사회복지전문직의 재량행위 보호와 책임성강화, 사회복지 직업 영역의 독점을 위한 사회복지사업법의 정비가 필요하다. 이를 위하여 사회복지사의 자격과 직무의 범위를 명문화하고 사회복지전문직 별 직무분석, 기술의 훈련과 실천, 타 전문직의 협력에 관한 사회복지법상의 자격과 직무의 명확화가 필요하다.

영어초록

The system for social workers in Korea has been developed as a form of education about the characteristics of social workers and the license system grounded on the Social Welfare Services Act. The institutional attributes of social welfare professions are stated in the law related to social welfare in terms of the qualifications and duties of professions, educational system, education and training, expert groups, employment duties, and the enhancement of their status; therefore, they satisfy the conditions of professions suggested by scholars.
The purpose of this study is to consider the qualifications and legal duties of social welfare professions and the characteristics of autonomy and discretionary acts in those professions in accordance with institutional attributes. Regarding the ways to reinforce the activity of social welfare professions and enhance their identity in Korea, first, it is necessary to define “social workers” in detail legally. It is needed to establish rules to have them be equipped with expert qualifications stated in social welfare-related legislations by completing the major course of social welfare and accumulating their career through training in particular area. Second, social welfare professions’ autonomy and discretionary power should be understood in the perspectives of authority, discretionary acts, and expert ethics grounded on the laws. Since private consignment organizations should not be involved in any tasks directly related to people’s rights or duties which the government is responsible for, the autonomy of professions can be secured through discretionary acts. Third, to increase the responsibilities of social welfare professions and monopolize the area of welfare, the legislations of social welfare should clearly establish the range of jobs provided to social workers. In this way, it is possible to secure the effectiveness of the system for social workers. Fourth, it is needed to reorganize the system about social workers’ qualifications to enhance their expertise. Also, regarding the ways to increase compulsory subjects legally designated, it is necessary to reorganize the subjects that are needed to cultivate generalist and specialist social workers in different areas of welfare. The Social Welfare Services Act will have to add detailed major-related regulations and articles about duties to “carry out supervision over social welfare”.
Also, it is necessary to allow field practice for social welfare in two or three areas and gradually deepen the course for essential education in order to enhance expert competencies. Fifth, it is needed to provide practical support to manage the status of social welfare professions. The matter related with how to treat social welfare professions is up to the central government and local autonomous entities. Because bettering welfare for social workers is also a factor to enhance the status and identity of their professions, it is needed to improve social workers’ expertise and enhance the quality of welfare services for people under the Social Welfare Act.
