초록

본고는 조선총독부의 식민지 조선 지배를 위해 1910년 만들어진 제령(制令)의 일본 제국의회 통과과정을 검토한다. 제령은 조선총독에게 입법권을 부여하는 것으로, 이로써 조선총독은 입법, 사법, 행정의 삼권을 장악하는 군주와 같은 존재가 되었다. 제령은 한일병합과 함께 긴급칙령으로 만들어졌다. 긴급칙령은 제국의회의 승인을 받아야 하기 때문에 제국의회의 입법 협찬권과 충돌할 수 있었다. 제령 승인은 한일병합 직후의 제27회 제국의회에서 중요한 정치문제로 다루어졌다.
한일병합을 전후한 시기 일본정치는 번벌세력과 정당세력의 대립과 타협에 의해 전개되었다. 식민지조선에 대하여 번벌세력은 (의회)정치로부터 독립적인 식민지 조선의 운영을 기대하였다. 한편 제국의회의 정당세력은 식민지 조선을 일본정치의 지배영역에 포함시키려고 하였다. 제27의회를 앞두고 제2차 가쯔라내각은 예산과 주요정치 현안을 회기내 처리하려고 하였고, 다수 정당인 정우회는 차기 정권을 요구하였다. 가쯔라수상은 예산통과와 제령의 승인 등 정치현안을 해결하기 위해 정우회에게 정권수수의 의향을 내비쳤다.
중의원에서 제령권이 본격적으로 논의되면서 중의원 내에서 제령권 승인 반대의 목소리도 높아졌다. 의회는 제령권을 긴급칙령이 아닌 법률로 규정하고 효력기한을 설정하여 제국의회의 통제를 받도록 하려고 하였다. 그러나 번벌정부는 반대하였고 정우회는 차기정권의 획득이라는 정치적 목적을 위해 제령권을 승인하였다. 그러나 승인된 제령권은 칙령이 아닌 법률로 규정되어, 정우회와 제국의회는 식민지조선에 대한 영향력을 유지할 수 있었다.

영어초록

This article aims at clarifying an aspect of modern Japanese political history concerning colonial Korea, and for the purpose, analyzes the legislating process of the Colonial Regulations at the Japanese Imperial Diet around 1910. The Colonial Regulations or seirei(制令) gave legislative power to the Governor General of Korea, and made him a tyrannical ruler with all the three rights of legislation, administration, and judicatory.
The Colonial Regulations were made as an Imperial Emergency Order(緊急勅令) on theoccasion of colonizing Korea and required approval of the Imperial Diet, while giving way to the possibility of clashing with the Imperial Diet's right of sponsoring legislation. Thus, the approval of the Colonial Regulations became an important political issue at the twenty seventh Imperial Diet.
Japanese politics around the annexation of Korea were severely influenced by opposition and compromise between two main political agents of hanbatsu on the one hand and political party(Seiyukai) on the other. On the colonial Korea, hanbatsu expected the independence of Korean administration from political parties in Japan, who were trying to include Korea into Japan's domain. The second Katsura cabinet was trying to finish the budget and other political issues during the session, and Seiyukai, the majority party, was claiming power to establish next cabinet. As to Seiyukai's claim, the prime minister showed intention of yielding power to Seiyukai.
Debates concerning the Colonial Regulations at the House of Representatives brought out the oppositional voice against the regulations. Seiyukai tried to define the regulations as a law, not as an Imperial Emergency Order, and impose the expiration date for putting them under parliament control. In the result, in spite of the hanbatsu government's opposition against the legislation, Seiyukai approved the regulations but no time limit, in order to grasp the power at the next term. The approved regulations, however, was established as a law but not as the Imperial Order, and this made Seiyukai and the Imperial Diet have influence over colonial Korea.
