신라 중고기 율령의 정치적 공공성에 관한 시론 (A Theory about the Political Publicness of the Rule in the Middle Age of Silla)

초록

율령은 왕권의 강화와 함께 백성들의 일상에 사적으로 운영되는 상위지배층들의 영향력을 줄이고 대신 국가권력을 이들에 직접 침투시키는 과정이라고 볼 수 있다. 따라서 신라에 있어서 율령의 성립과 제정은 결과적으로 신라사회의 공동체로서 어느 정도 공공의 이익을 창출하려는 현상으로 나타날 수 있다. 이는 신라 공공성의 구현주체가 국가와 왕이라고 볼 수 있으며 수혜자 역시 국가와 왕인데 여기에 직･간접적으로 일반민(백성)이 포함될 수 있다.
이와같이 신라의 율령은 공공성을 도모하기 위한 구체적 정책의 구현으로 어느 정도 의미를 갖는다. 그러나 동시에 다른 한편으로 신라는 권력이 일부 왕을 비롯한 소수의 지배층에게 집중된 정치체제를 가진 봉건적 시대의 사회로서 율령의 성립과 제정이 절대자의 통치를 정당화하고 사회질서를 공공히 하는데 일조하기도 하였다. 그러므로 엄밀한 의미에서 고대의 율령은 공공성에 대한 현대인들의 인식과 거리가 있으며 근･현대의 서양에서 성립된 공공성의 이상에는 부합하지 못한 측면이 있다.
인간의 권력에 대한 욕구는 각각의 시대적 배경으로 인한 사회인식이라든가 정치체제 등이 다르다고 할지라도 근본적으로 변함이 없다. 따라서 국가를 형성하는 구성원 내에서는 소수의 권력독점에 대한 끊임없는 반발심이 일어날 수밖에 없다. 그러면 소수의 권력자는 이러한 반발을 억압하고 무마하는 움직임을 보이게 된다.
정치적 공공성은 사적 권력의지나 이해관계들과 대립하는 가운데 도모되는데 소수의 권력자는 이를 확대해 나가는 사회체제를 만들어가는 동시에 자신의 통치를 정당화하는 방향으로 나아가기 마련이다. 율령은 각 집단간 또는 지역간 분산되어 있던 관습법을 포괄하면서 그것을 초월하는 국가 전체에 작용하는 일원적인 공법체계(公法體系)의 수립과 그러한 법체계가 성립하고 기능을 발휘할 수 있는 바탕으로서의 중앙집권적 권력이 점차 확립되어가고 있었을 때 제정되는 것이다. 그러므로 법흥왕대 신라 율령의 반포는 이전 시대보다 좀 더 공공성으로 나아가는 일종의 발판이 되었음을 의미하며 그만큼 이전과 다른 사회질서가 수립되었다고 볼 수 있다.

영어초록

The rule of Silla is the process of strengthening the royal authority and reducing the influence of the upper ruling class, which is operated privately in the daily life of the people, and infiltrating the national power instead. Therefore, the establishment and enactment of the ordinance in Silla can be a phenomenon to create some public interest as a community of Silla society. This can be seen as the embodiment of Silla political publicity as the state and the king, and the beneficiary is also the state and the king, which can include the people directly or indirectly.
As such, the rule of Silla has some meaning as the implementation of concrete policies to promote publicness. On the other hand, however, Silla society was a feudal era in which power wae concentrated on a few ruling classes including some kings, and the establishment and enactment or the rule of the law contributed to justifying the rule of the absolute and publicizing the social order. In this respect, there is a distance from modern people’s perception of publicness and there is a side that does not meet the ideal of publicness established in the modern western world.
The desire for human power is fundamentally unchanged even if the social awareness or political system are different due to the background of each era. Therefore, in the members who form the state, there is a constant opposition to a small number of monopoly powers. Then a few powers will suppress and move to suppress this rebellion.
Political publicity is promoted in the face of confrontation with private power will and interests. A small number of powers are making a social system that expands it and moving toward justifying their own rule. The rule of law is enacted when the establishment of one way public law system that works on the whole country that transcends it and the centralized power that can establish and function such a legal system are gradually established, encompassing the common law that was dispersed between each group or region. Therefore, the Banpo of Silla rule the reign of King Beopheung means that it became a kind of foothold to move toward publicness more than before, and it can be seen that the social order is established as much as before.
