결과주의적 공리주의 비판에 대한 정당성 고찰 (Review on the justification for criticism utilitarianism of consequentialism)

초록

본 연구는 공리주의의 한 구성요소이기도 하면서 동시에 공리주의의 특수한 상정들을 일반화한 사상이기도 한 결과주의(consequentialism)가 윤리이론으로서 어떻게 정당화될 수 있는지에 대해 고찰한 것이다. 공리주의는 지난 두 세기 동안 인간 생활 전반에 걸쳐 광범위한 영향력을 행사해 왔다. 특히 공리주의가 법, 정치, 경제 및 도덕에 미친 영향은 괄목할 만하다. 이런 공리주의의 가장 큰 속성이 바로 결과주의이다. 그것은 공리주의는 행동의 결과가 좋으냐 나쁘냐에 따라서 행동의 올바름과 그름을 판단하기 때문이다. 즉 공리주의는 좋은 것을 행위하는 것이 옳다라는 논지로 압축할 수 있다. 달리 말해서 이는 공리주의가 아무리 수정되었어도 그 본원적인 결과주의적 속성은 그대로 남아 있는 것이다.
한편 롤즈가 직관주의와 공리주의에 대한 대안으로 분배적 정의에 근거한 비결과주의적 정의론을 제시한 이후 오늘날 개인 도덕은 물론 공공 도덕마저 공익보다 개인의 자유와 권리에 우선성을 두는 의무론적 윤리관이 정설로 인정받게 되었다. 특히 오늘날 규범적 정치철학에 관심을 갖는 대부분의 학자들은 일단 롤즈의 방법론을 논의의 출발점으로 한다는 의미에서 오늘날의 학도들을 롤즈 이후의 세대(post-Rawlsian)라 부를 정도이다. 또한 비결과주의에 의하면 결과주의는 사회 전체적 선을 극대화할 것을 요구하는 소극적 책임으로 개인의 온전한 삶을 위협할 가능성이 있다. 이에 윌리엄스는 개인 온전성 반론을 제기하며, 결과주의가 개인의 근본적인 삶의 계획을 체계적으로 위협할 수 있다고 주장한다.
따라서 본 연구는 결과주의가 이러한 비판들에 맞서 결과주의가 전체적 선 개념의 수정과 분배에 민감한 결과주의 이론 등으로 발전시킴으로서 대응하고 있음을 살펴본다. 이는 달리 말하면 목적론적 공리주의는 도덕이론이 아니라는 킴리카(W. Kymlicka) 등의 비판이 부당함을 논증해 보이는 것이라고 할 수 있다.

영어초록

This study attempted to examine how consequentialism has been justified as an ethical theory, although it is an idea having generalized specific hypotheses of utilitarianism as well as a constituent of utilitarianism. For the past two centuries, utilitarianism has exerted its extensive influence all over the human lives. Especially, it is noticeable how much influence utilitarianism has had on law, politics, economy and ethics. The biggest attribute of utilitarianism is the very consequentialism. It is because utilitarianism judges between right and wrong on a certain behavior, depending on whether the consequence of the behavior is good or bad. In other words, no matter how much utilitarianism has been modified, its original attribute of consequentialism still remains as it is.
Meanwhile since Rawls presented a theory of distributive justice based on non-consequentialism as an alternative for intuitionism and utilitarianism, deontological ethical theory has been recognized as a widely-accepted theory, which takes priority of individual freedom and rights over public interest in terms of today's public morals as well as individual morals. Especially, interested in normative today's political philosophies, most scholars even call today's students a generation of post-Rawlsian in the sense that Rawls's methodology should be a starting point of discussion most of all. Also according to non-consequentialism, consequentialism requires that the socially-overall line should be maximized, which has a possibility to threaten individuals' intact lives with negative responsibility. Hence, Williams insisted that consequentialism might systematically threaten plans of individuals' fundamental lives by setting forth a counter-argument for personal integrity.
Accordingly, this study examined how consequentialism has coped with such criticisms by modifying the overall-line concept of consequentialism and developing it into theories of consequentialism, sensitive to distribution. In other words, this study is to demonstrate that the criticism of such scholars as Kymlicka is unreasonable, which teleological consequentialism is not a moral theory.
