초록

본 논문은 교회 재산 관리 행위의 교회법 및 민법상 책임 문제를 다루고있다. 교회 재산의 관리는 취득된 재산을 보존하고 고유 목적에 따라 사용하는 일종의 통치권(potestà di governo)의 행사이다. 따라서 교회 재산의 관리는 그 재산이 속한 인격체를 직접 다스리는 자에게 속한다. 곧 교회 재산에대한 관리 행위는 집행권을 행사할 수 있는 권한과 관련된다. 현행 교회법전은 교회 재산 관리의 안정성을 보장하기 위한 시스템을 잘 규정하고 있으며, 이 규정들이 올바르게 적용된다면 교회 재산의 안전과 선량한 관리가 보장될 수 있을 것이다. 반면 재산 관리에 대한 이러한 교회법적 시스템과 규범들이 제대로 작동되지 않을 때, 국가법적으로 불법행위책임을 구성할 수 있으며, 교회에 더 큰 손해를 야기할 수 있다는 점을 항상 유의하여야 한다. 교회 법인의 불법행위책임을 예방하기 위한 조치로써, 교회 단체를 민법상비영리 법인으로 설립하고자 할 때는 교회법상의 재산 관리에 관한 규정, 특히 고정 세습 자산과 이례적 관리 행위와 양도 행위의 유효성을 위한 규정이나 대표권을 제한하는 규정들을 정관에 반드시 기재하여 민법상의 적법한절차와 일치시킬 필요가 있다. 그렇게 될 때, 교회법상 적법한 재산 관리 행위는 곧 민법상으로도 적법한 재산 관리 행위가 될 수 있고 거래의 안전과교회 재산의 안정성을 보호하는데 큰 도움이 될 것이다.

영어초록

This paper deals with the issues of the liability for the acts of administration of ecclesiastical goods under canon law and civil law. The administration of ecclesiastical goods is an exercise of a kind of governing power (potestà di governo) to preserve the acquired goods and use them for their own purposes.
Therefore, the administration of ecclesiastical goods pertains to the one who immediately governs the person to which the goods belong. In other words, it is related to the authority to exercise executive power. The current Code clearly stipulates a system to ensure the stability of the administration of ecclesiastical goods, and if these regulations are applied correctly, the safety and the good administration of ecclesiastical goods can be guaranteed. On the other hand, it should always be noted that when these canonical systems and norms for the administration of goods do not function properly, it can constitute tort liability under national law and cause greater damage to the Church. As a measure to prevent the tort liability of juristic person of the Church, when an ecclesiastical organization seeks to be established as a non-profit juristic person under civil law, it is necessary to align with the legal procedures of civil law, by making sure to include regulations for the administration of goods under canon law in the Articles of Incorporation, especially regulations for the temporal goods, the validity of acts of extraordinary administration and acts of alienation or regulations limiting the right of representation. When these conditions are met, the acts of legal administration of goods under canon law can also become legal under civil law and they will be of great help in protecting the safety of transactions and the stability of the temporal goods of the Church.
