우리나라 자치경찰제의 올바른 방향 모색에 관한 연구 (A Study on the Tasks and Future Direction of the Unified Autonomous Police)

초록

1948년 정부수립과 함께 창설된 대한민국 국립경찰은 약 72년간 중앙집권적 국가경찰체제를 종식하고, 2021년7월 1일부터 광역시 도별 자치경찰제가 전면 시행하게 된다. 2006년 제주자치경찰제 시범실시를 통해 국가경찰과자치경찰이 분리된 이원화 모델을 추진하여 왔으나, 코로나19로 인한 국가재정 악화 및 과다한 초기비용 부담 등을이유로 2020년 7월 30일 관계기관 및 당 정 청 협의를 통해 일원화 모델로 변경하게 되었다.
자치경찰제 도입 취지는 지방행정과 치안행정의 연계성을 확보하고 지역특성에 적합한 치안서비스를 제공하기위하여 도입되어야 하며, 자치경찰은 국가의 순기능을 보장하면서 지방분권이라는 자치성에 입각하여 그 지역의 특수성과 자율성을 충족시키는 차원에서 실시되어야 한다.
하지만 갑자기 일원화 모델로 변경되면서 지역경찰을 생활안전과에서 112치안종합상활실로 소속 변경, 지휘권분산으로 인한 조직통제력 약화, 자치경찰위원회 권한의 불명확 등 문제점에 대하여 시범운영을 통해 개선해 나가야 한다.
자치경찰제의 올바른 방향을 위한 개선방안은 첫째, 자치경찰사무가 경찰 본연의 임무범위를 벗어나 자치단체사무로 확대되지 않도록 해야 할 것이며, 자치경찰이 국가경찰과 수사경찰에 비해 상대적 소외를 받지 않도록 처우개선을 위한 노력을 해야 한다. 둘째, 시 도 자치경찰위원회 권한의 범위와 한계를 명확히 하여 위원회의 권한밖 행위로 인해 발생할 수 있는 논란을 사전에 차단하고, 전면 시행 이후에는 더 이상 논란이 없도록 해야 한다.
셋째, 자치경찰위원회 사무기구 공무원을 선발할 때 자치경찰에 대한 전문성을 갖춘 직원을 선발하여, 자치경찰제도가 안정적으로 정착할 수 있도록 해야 할 것이다.
지역특성에 맞는 자치경찰제가 성공하기 위해서는 지방자치별 재정 여건에 따른 중앙 정부의 적극적인 지원과자치단체별 자치경찰 교부세 등 별도의 재정지원 방안이 마련돼야 하고, 자치분권위원회를 비롯한 중앙정부의 지속적인 관심과 협력이 뒷받침 되어야 할 것이다.

영어초록

Founded in 1948 with the establishment of the government, the Korean National Police Agency will end the centralized national police system for 72 years and implement the Autonomous Police system for each metropolitan city and province from July 1, 2021. In 2006, the Jeju Autonomous Police System demonstrated a separate dualization model by way of showing an example, but it was changed to a unified model through consultations with related agencies, the party, the government, and the Blue House on July 30, 2020, such as worsening national finances and excessive initial costs caused by COVID-19.
The purpose of introducing the Autonomous Police system should be introduced in order to secure the connection between Local and public security administrations and to provide security services suitable for regional characteristics. It should be carried out in a dimension that meets the requirements.
However, with the sudden change to the unified model, problems such as the change of affiliation of the local police from the Life Safety Division to the 112 Public Security Office, the weakening of organizational control due to the dispersion of command, and the unclear authority of the autonomous police committee must be improved through pilot operation.
The improvement plan for the right direction of the municipal police system is First, the self-governing police office should not extend beyond the scope of the police’s natural mission and expand to selfgovernment offices, and efforts should be made to improve treatment so that the self-governing police are not relatively alienated compared to the national police and investigative police. Second, it is necessary to clarify the scope and limitations of the authority of the municipal and provincial self-governing police committees to block controversy that may arise due to actions outside the authority of the committee, and to prevent further controversy after the full implementation. Third, when selecting public officials in the Office of the Autonomous Police Committee, it is necessary to select employees with expertise in self-governing police so that the self-governing police system can be settled stably.
In order for the self-governing police system to be successful in accordance with regional characteristics, active support from the central government according to the fiscal conditions of each local government and separate financial support measures such as the self-governing police issuance tax for each local government must be prepared. Cooperation will have to be supported.
