조선시대 향촌 제 組織과 規約의 ‘契約’적 성격 (Several Local Community Organization of the Choseon Dynasty and the Nature of Their Rules as 'Social Contracts’)

초록

이 연구는 조선시대 향촌사회에서 실시되거나 작성되었던 향약, 동계ㆍ동약, 또는 계 등의 향촌 제 조직과 규약에서 ‘계약’적 요소를 확인해 보고자 한 것이다. 그리고 그것의 구체적인 내용이 어떠하였으며, 나아가 계약의 발전사적 측면에서 신분제와 공동체적 기반에 근거한 ‘권위적 계약’이 오직 자유로운 상호 협의에 기초한 ‘수평적 계약’으로 발전해 가는 과정에 대해서도 관심을 가져 본 것이다.
여기서 계약이란 기본적으로 “개인의 자유로운 合意에서 생긴 사회질서”, 또는 “對等者間의 合意에 의한 約束”이며, 이러한 질서와 약속이 자율적으로 지켜져야 한다는 소박한 관점에 기초한다. 이러한 점에서 조선시대 향촌 제 조직과 규약은 合意, 約束, 立約, 上下同約 등으로 이름 붙여지거나 그것을 전제로 성립된 것이라는 점에서 ‘계약’적인 성격을 확인하기란 그리 어렵지 않다.
조선시대 향촌 제 조직과 규약은 상호간의 약속으로 성립되었지만, 그것은 분명 신분제와 공동체적 관계를 기반으로 한 강제적 또는 신분제적 계약이었다. 따라서 그 권리와 의무 또한 유교적인 가치와 신분적인 질서의 확립을 전제로 하고 있었다. 그러나 그 강제는 국가나 관의 일방적인 명령과는 다른 군현 또는 촌락단위에서 자율적인 약속과 규약에 의한 것이었고, 운영권자의 독단은 원칙적으로 봉쇄되어 있었다는 점에서 상당한 합리성을 가지고 있었다. 더욱이 18, 19세기에 이르러서는 강제의 강도와 대상이 약화되거나 한정적이었다. 이에 따라 하층민들은 그들의 필요와 목적에 의해 수평적인 다양한 각종 계를 성립ㆍ발전시킬 수 있었다.
조선시대 향촌의 여러 조직과 규약, 곧 ‘계약’은 전반적으로 그 성립에 있어서 신분을 기초로 하였다는 점에서 신분적 또는 강제적인 측면을 가지며 또한 정치적 통제와 합치됨으로써 사회조직을 규율하는 거대한 규모의 질서를 보완해 주는 구실을 하였다. 그러나 참여자 상호간의 수평적 계약이 민중의 세계에서 면면히 이어져 오고 있었음도 확인할 수 있었지만, 이것을 충분한 자료로써 중요하게 부각할 수는 없었다.

영어초록

The 'contractual' elements embedded in Hyang'yak, Dong'gye, Dong'yak and other mutual-aid societies were carefully examined in this article. First, whether we could secure some of such aspects (like the element of 'free-will' or 'voluntary agreement') or not, were ascertained. And second, the existence of such aspects was verified through various facts of the above-mentioned Choseon organizations, in terms of the scope of the contract, privileges and obligations dictated by the contract, and the nature of the contract itself(compulsory or not). Also, how such 'contracts' with a rather 'imperfect' nature, produced by a society determined by a society determined by social-class discriminations and local limitations, transformed themselves into more advanced social contacts was examined as well.
The term 'Contract' basically refers to a kind of "social order that was generated by an agreement made by free-willed individuals", or a "promise based upon agreements between equal beings". In other words, 'contracts' are only a legal format, or an instrument of a social or economic order, and its existence and continuation primarily depends upon societal needs and requirements. Above all else, 'contracts' exist to be observed and obeyed. In this regard, it is not a difficult task to trace certain elements that could be considered as elements of a 'contracts' from the local rules of Choseon. They were all named with term like ‘agreement/合意,’ ‘promise/約束,’ ‘established promise/立約,’ and ‘agreement formed between the upper and lower levels of a county/上下同約’. They were inherently 'contracts.'The Choseon local rules and localized organizations were based upon the ‘mutual agreement format but, those are under the discriminative social stratification system, and localized community system. Therefore, privileges and obligations also premise uphold the Confucian values and the social-class-based order. However the force was being operated autonomously in either Gun&Hyeon regions or small areas like villages and counties, and not by the unilateral orders of the state government. Their regulations were not official and rather private and civilian. The chief overseers were prohibited by the system form abusing their power and arbitrarily running the unit, and that was a reasonable precaution on their part. Moreover, the Dong'gye and Dong'yak units of the 18th and 19th centuries showed lesser degree in their forcible nature, and the size of the group of people who were the object of such forcing got smaller and smaller. So, lower class people could escape and do other things they wanted, to eventually form their own Gye units that fit their own wished and agendas.
'Contracts' in other words, various formats of local rules and local bodies of the Choseon dynasty period, were based upon the social class system, in that regard they were not totally free or voluntary ones, but instead partially obligatory and also to some extent 'forced' ones, and alongside political governing they served as an instrument, supplementing and reinforcing the overall social order. However, horizontal contracts must have existed in the realm of commoners and peasants. Yet documents that testify the existence of such contracts are almost nonexistent.
