초록

법무보호복지대상자들은 본인의 형기동안 외부세계와 차단되어 수용시설에서 구금생활을 하고 출소 후에도 격리되었던 시간만큼 변화된 사회에 적응하며 살아가기에는 많은 어려움이 따른다. 이 시기에 많은 관심과 물질적·정서적 지원이 뒷받침 되지 않는다면 재범으로 연결될 개연성이 매우 크기 때문에 법무보호복지제도의 활성화는 우리사회의 범죄율을 낮추는 가장 중요한 요소라고 할 수 있다.
이에 본 연구는 현재 우리나라에서 출소자들에 대한 제도적 지지체계인 법무보호복지제도를 중심으로 역사, 조직, 사업내용 등에 관한 현황을 분석해 보고 발전방안에 대하여 연구하였다.
주요 연구방법으로는 문헌조사 방법을 중심으로 관련 법률과 국내·외 단행본 및 연구총서를 조사·연구하였다. 출소자들의 실태를 분석하기 위하여 범죄백서, 대검찰청 범죄분석 등 각종 통계자료를 분석하였고, 현장에서 법무보호복지사업을 추진하고 있는 공단 실무진들의 의견을 적극 분석 · 반영하였다.
이를 바탕으로 다음과 같은 발전 방안을 제시하였다.
첫째, 법무보호복지사업에 대한 독자적인 관련법률 제정이다. 현 보호관찰등에관한법률 내에서는 효율적인 범죄예방사업을 진행하기에는 한계가 따르므로 발전적 내용을 규정한 독자법률 제정이 우선시 되어야 한다.
둘째, 법무보호복지사업의 확대이다. 정부예산 뿐 아니라 기업들의 사회공헌 기금, 벌금수입 등 범죄예방기금을 마련할 수 있도록 법률상 재원확보방안을 명문화 하여야 한다.
셋째, 미래 지향적 사업기반 마련이다. 이를 위해 1인 1실 생활관으로 시설의 현대화는 물론, 사회 내에서 치료가 필요한 중독범죄자(정신질환자, 약물, 알콜, 도박 등), 여성, 노인출소자 등 특수 취약계층 범죄자에 대해 강제적 보호와 치료를 할 수 있는 전문시설이 확충되어야 한다.
넷째, 법무보호복지사업의 패러다임 전환이다. 현재 임의적 보호사업에서 사회가 적극적으로 개입해야 할 대상자들에게는 조건부 가석방제도 및 조건부 기소유예 제도 등을 적극 도입하여야 하며, 중간처우의 집을 운영하여 선제적이고 적극적인 보호사업을 전개할 필요가 있다.
이와 더불어, 2020년 코로나 19확산으로 언택트(untact) 시대에 맞는 시스템이 도입되어야 한다. 교정기관과 상시 화상상담을 할 수 있는 시스템, 재소자들이 공단의 프로그램을 체험할 수 있는 가상현실 시스템, 자율형 생활관 운영에 따른 지능형 CCTV등 AI 도입으로 법무보호대상자들의 자율성 존중과 직원들의 근무환경 개선을 위한 4차 산업혁명 시스템 확충이 필요하다.

영어초록

People who are subject to the rehabilitation system are separated from the outside world during the period of their imprisonment. Even after release, it is difficult for them to adapt to a society that has changed as much as the time of their imprisonment. If there is no physical and/or emotional support, it is more likely for them to be led to the criminal world once again. Therefore, the activation of the rehabilitation system is one of the most critical factors in lowering the rate of crime in our community.
Therefore, this study analyzed the current status of history, organization, and project contents, centering on the criminal justice rehabilitation system, which is an institutional support system for ex‐prisoners in Korea, and studied development measures.
As for the main research method, this study was to investigate and study related laws, domestic and foreign books and research series, focusing on the literature search method. To analyze the actual conditions of ex‐prisoners, various statistical data such as crime white papers and crime analysis at the Supreme Prosecutors' Office were analyzed, and the opinions of the staff members of the Korea Rehabilitation Agency, who are promoting the rehabilitation system in the field, were actively analyzed and reflected.
Based on this, the following enhancement measures were proposed.
First, it is the enactment of independent related laws on criminal justice rehabilitation programs. Since there are limitations to implementing effective crime prevention projects within the current probation law, the enactment of an independent law that stipulates the developmental content should be given priority.
Second, it is the expansion of criminal justice rehabilitation programs. In addition to the government budget, it is necessary to stipulate measures for securing financial resources to prepare a crime prevention fund such as corporate social contribution funds and fine income.
Third, it is to prepare a future‐oriented program foundation. For this, as well as modernization of the facilities as a one‐person one‐room dormitory, especially for vulnerable criminals such as addiction offenders (mental disorders, drugs, alcohol, gambling, etc.), women, and elderly ex‐prisoners who need treatment within society, professional facilities that can provide compulsory protection and treatment should be expanded.
Fourth, it is a paradigm shift in criminal justice rehabilitation programs. The conditional parole system and conditional probation deferred system should be actively introduced to those subject to active intervention by society in the current voluntary protection project, and it is necessary to conduct preemptive and proactive protection programs by operating the halfway houses.
In addition, with the spread of Covid‐19 in 2020, a system suitable for the untact era should be introduced. With the introduction of AI, such as a system for constant video consultation with correctional institutions, a virtual reality system that allows inmates to experience the program of the Agency, and intelligent CCTV based on autonomous dormitory operation, it is necessary to expand the 4th Industrial Revolution system to respect the autonomy of rehabilitation recipients and improve the working environment of employees.
