교단헌법의 입법론적 문제점과 과제 (Legislative Problems and Tasks of the Constitution of the Church)

초록

본 논문에서는 교회헌법-노회규칙-교회정관으로 연결되는 교회 내부의 법적체계를 통해 교회 내의 의사결정과정과 그에 따른 활동을 살펴보는 것이 맥락적으로 합리적이지만 여기서는 교회헌법의 입법적 체계정당성부분을 중심으로 다룬다.
특히 법적 체계정당성의 원리를 원용하여 교회헌법이 만들어졌는가에 대한 분석을 통해 교회헌법의 법적 정당성을 구체적인 예시와 함께 분석하면서 대안을 모색한다.
교회내부의 자율적 구속관계로 교회헌법-노회규칙-교회정관을 법적인 관점에서 규명하고 교회헌법이 현실에 적응하면서 살아있는 교회헌법 조문으로 새롭게 나타나야 한다.
교회 내 교회헌법이 노회규칙과 교회정관을 구속하는 실적적인 상위법이지만 오히려 지교회정관이 상위법을 압도하는 사법적 판례의 경향은 매우 우려스러운 일이라 할 수 있다.
이런 이유로 본 논문에서는 교회헌법이 가지는 상징성과 법적 위치를 정확히 규명하고 교회 내부의 법적인 질서와 현실에 부합하는 법률로서의 위상을 가져야 한다.
시류에 따라 민주적이고 독립적 운영이라는 명분으로 행해지는 교회정관의 제·개정에서 나타난 불합리성을 지적하고 교회개혁과 교회의 내적 독특성을 함의하면서 교회공동체의 목적을 함께 이루어 나가는 교회헌법의 방향성을 주목한다.
명문화된 교회정관과 노회규칙과의 상관관계를 통해 교회정관을 정치하게 규정할 조문의 필요성을 절감하면서 교회 내 구성원들 간의 권한과 책임을 분명히 하고 불필요한 갈등을 미연에 방지하며 교회공동체 운영의 합리화를 통해 교회의 존재에 관한 의미를 실현하는 것을 기대하게 된다.
본문에서는 개신교 교회의 내부적 법률관계를 명확하게 규명하는 것과 교회생활에 부합하는 생활 속의 법으로 신앙과 현실 속의 간극을 합리적으로 줄이는 실질적인 지침이 될 것이라 확신한다.

영어초록

In the text, it is rationally reasonable to examine the decision-making process within the Church and its activities through the legal system within the Church, which is connected to the Constitution of the Church – the Presbytery rules - the Church Constitution, we address the legitimacy part of the legislative system of the Church Constitution.  In particular, we try to find alternatives by analyzing the legitimacy of the Constitution of the Church through concrete analysis of whether or not the Constitution of the Church has been created by using the principles of the legal system.
I am eager to see the new Constitution of the Church as an autonomous restraint within the church from the legal point of view as the Constitution of the Church.
Although the church's constitution in the church is a high-level law that binds the old law and the constitution of the church, it can be said that the tendency of judicial cases in which the Constitution of the Church overcomes the high law is very concerned .
For this reason, the text emphasizes the need to accurately identify the symbolism and legal position of the Constitution of the Church and to maintain its position as a law compatible with the legal order and reality within the Church .
It is noteworthy that, while referring to the irrationality indicated by the revision of the Constitution of the Church in the name of democratic independence, along with the temporal flow, it implies the church's reform and the internal poisoning characteristics of the church. We pay attention to the direction of the Constitution of the Church, which is carried out together with the purpose.




By using the correlation between the constitution of a cultured church and the Presbytery rules, it is necessary to clarify the authority and responsibility among the members of the church, while reducing the necessity of the provision of the articles of the church to politics, It is hoped that it will prevent conflicts from occurring and realize the significance of the existence of the church through streamlining the operation of the church community.
In this article, I firmly believe that it is a clear guide to clarify the legal relations within the Church of the Protestant Church, and that it will become a practical guideline to rationally reduce the gap between faith and reality in the laws of life that fulfill the Church's life .
