드론의 전 생애주기를 반영한 독립 법제 제정의 필요성 (The necessity of enacting independent legislation reflecting the entire life cycle of drones)

초록

드론은 제4차 산업혁명의 선두라고 해도 과언이 아닐 정도로 오늘날 빠르게 발전하고 있는 개체로서 전 세계가 드론산업육성에 주목하고 있다. 드론은 최첨단기술의 검증과 인간의 향상된 정서적 문화 수준을 그대로 반영하기 때문에 현재 우리나라의 드론법은 드론의 활용과 산업 발전 및 육성・촉진에 집중하고 있는 실정이라 드론산업의 확장에 따른 위험요소 및 부작용 등에 대한 규제를 강화할 필요가 있다. 우리나라는 「항공안전법」을 중심으로 드론의 제작・소유・운용에 관한 규제를 다루고 있는데, 이는 크게 중량과 사업 여부에 따라 다르게 적용되고 있다. 드론의 신고, 조종자증명, 비행공역 및 조종자 준수사항 등 항공 관련 법령을 국제표준 및 주요 항공선진국에서는 우리나라와 달리 별도의 독립된 장으로 편성하거나 별도의 법률을 제정하여 보다 세부적으로 구분하고 있는 데 반해, 우리나라의 드론 관련 법령은 수많은 관련 법률들에 산재되어 있어 실질적 적용에 많은 문제가 있다. 가장 기본적으로 법률 내 확립한 용어조차 실무에서 통일되지 않고 있고 실무에서 제시하는 기준을 법률에 반영하지 못하고 있을 뿐만 아니라 이에 따라 안전관리 기준 및 운영에 있어서도 법령과 실무에서 괴리가 발생하고 있다. 국토교통부는 드론의 안전성 제고를 위하여 일부 규제를 강화하는 방안을 마련하였지만 기체 신고, 안전성 인증 및 비행승인, 조종자증명 제도 등에 대한 관련 규정의 불비와 지나친 규제 완화로 입법 부작위와 단순한 형식적 규제가 이루어지고 있다는 것도 문제가 크다. 또한 운용 중인 드론에 대한 통제 수단이 부재하고 위법한 비행 중인 드론을 단속하는 것도 한계가 있으며 운용을 마친 드론 처분에 관하여는 그 어떤 계도장치도 없다는 점에서 공법적 규제가 시급하다 할 것이다. 따라서 본 연구에서는 드론의 전 생애주기별 단계를 중심으로 각 단계별로 적용되고 있는 기존 법령들을 종합하여, 예컨대 드론 정의의 명확화, 책임보험의 입법화, 안전성 담보 규제의 강화, 실질적인 드론 단속 및 제작요건, 드론 처분 등 입법 불비 요소 보완 등의 개선방안과 더불어 법을 적용받는 국민이 쉽게 파악할 수 있도록 하기 위해 기존 항공기와 병존하여 규정하고 있는 현재의 드론 관련 법제를 개선하여 드론을 「항공안전법」 내 별도의 독립된 장으로 구성하거나, 개별 법률로써 새롭게 제정하는 등 향후 드론산업의 무한한 성장가능성과 드론이 사회 전반에 미칠 영향력을 고려하여 선제적으로 드론만을 다루는 법제를 마련하는 방향을 제시해 본다.

영어초록

It is no exaggeration to say that drones are the leader of the Fourth Industrial Revolution, and the whole world is paying attention to fostering the drone industry. Since drones reflect the verification of state-of-the-art technology and the improved emotional culture of humans, Korea's drone law is currently focusing on the use of drones, industrial development, fostering, and promotion, so it is necessary to strengthen regulations on risks and side effects from the expansion of the drone industry. Korea deals with regulations on the production, ownership, and operation of drones, focusing on the Aviation Safety Act, which is largely applied differently depending on weight and business status. Unlike Korea, aviation-related laws such as drone reporting, pilot certification, flight airspace, and pilot compliance are organized into separate chapters or enacted separate laws in major advanced aviation countries, while Korea's drone-related laws are scattered in many related laws, so there are many problems in practical application. Most basically, even the terms established in the law are not unified in practice, the standards presented in practice are not reflected in the law, and accordingly, there is a gap between laws and practice in safety management standards and operation. The Ministry of Land, Infrastructure and Transport has come up with measures to strengthen some regulations to improve the safety of drones, but the problem is that legislative omission and simple formal regulations are being made due to inadequate regulations on aircraft declaration, safety certification and flight approval, and pilot certification systems and excessive deregulation. In addition, public law regulation is urgent in that there is no control means for drones in operation, there are limitations in cracking down on drones in illegal flight, and there is no instructions for the disposal of drones that have been operated.
Therefore, in this study, the existing laws and regulations focusing on the stages of the drone's entire life cycle, it is applied at each stage are combined to improve measures such as supplementing legislative inadequacies, for example, clarification of drone definition, legislation of liability insurance, strengthening safety security regulations, practical drone crackdown and production requirements, drone disposal, etc. and to make it easier for the people subject to the law to understand, I will propose a direction to preemptively prepare legislation that deals only with drones to improve the current drone-related legislation, which is stipulated in conjunction with existing aircraft, to form a separate chapter in the Aviation Safety Act, or to enact a new individual law, considering the infinite growth potential of the drone industry and its influence on society.
