소년 다이버전에 관한 교정복지의 발전과제 (The developmental challenges of correctional welfare of Juvenile Diversion)

초록

오늘날 소년범죄에 대한 심각성은 우리나라 뿐만 아니라 전세계적으로 일반화되어가는 경향이 있다. 성인범죄자와 다르게 취급하려고 하는 소년법은 예컨대, 국친사상, 낙인이론, 개별화된 사법이론, 회복적 사법이론 등 그 이론적 배경이 다양하다. 최근까지 비공식적인 사법제도를 활용하려는 회복적 사법은 새로운 유형의 다이버전으로 각광을 받고 있으며, 형사범죄자에 대한 처벌보다는 지역사회에 기반을 두고 피해자와의 관계성에 중점을 두고 있다. 몇몇 연구들은 소년 다이버전에 대한 효과성에 회의적인 입장을 견지하고 있고 형사사법망을 확대한다는 우려를 표명하고 있다. 그럼에도불구하고 그것은 초범이나 경미범죄 등에 성인범죄자와 동일한 형사적 제재를 과하는 것은 우리의 미래인 아동들에게 씻지 못할 미래의 기회를 박탈할 우려가 있는 것이다. 더 나아가서 다이버전에 대한 충분한 이해없이 관행적인 다이버전은 경계하여야 할 것이다. 다시 말하면 강력한 처벌과 조화를 이루기 위한 실제적인 운용은 범죄의 위험성과 피해의 정도, 사회적 회복 프로그램 활용 등 엄격한 검토를 요한다. 소년사법에서 경찰, 검찰, 재판, 형행단계에 이르는 형사절차과정에서 다이버전을 활용하는 것은 소년인권을 보호하는 차원에서 신중한 실무적인 활용과 논의를 필요로 한다. 이와 더불어 앞으로 실제 소년사법 전과정에서 소년범죄자의 회복을 돕기 위한 교정복지사의 개입과 역할을 기대하여 본다.

영어초록

Today, the seriousness of juvenile crime is a common trend not only in Korea but also in the world. The juvenile law, which is intended to be treated differently from adult criminals in criminal justice, contains theoretical backgrounds such as parens patriae, stigma theory, individualized judicial justice, and restorative justice.
Until recently, the restorative judicial system, which utilizes a somewhat informal judicial system, has been spotlighted as a new type of diversion, focusing more on the harmful behavior caused by the community and victims than criminal offences. Some studies point to a very skeptical view of the effectiveness of the boys' diversion program and accuse it of causing harm to the existing criminal justice network. Nevertheless, it is feared that the use of criminal sanctions or criminal ideologies in juvenile offender who commit first-time crimes, minor misdeeds, or crimes may deprive of future opportunities or stigma that they will never recover due to trial errors.
Furthermore, rather than only expressing the effectiveness of the bureaucratic diversion without a deep understanding of the actual issues or expertise, the practical operation of the diversion will also be necessary depending on the severity of the incident and the degree of risk of crime. In other words, the need to find a way to harmonize with a strong punishment or lenient action in practice requires a sufficient review of social rehabilitation programs, recovery plans for victims, etc. along with appropriate sanctions for flight or crime, depending on the severity of the incident and the risk of crime. The current juvenile law established new regulations on juvenile delinquency prevention by introducing restorative justice, expanding diversions in the investigation stage, diversifying and internalizing protective disposition, and strengthening regulations on juvenile delinquency.
However, if the disposition of a disciplinary action against a juvenile offender can be called a diversion at the de facto police level, and if the police's diversion are allowed by expanding, there may be a problem that the prosecution's investigation command is not exceptionally applied to a juvenile offender, so practical discussions will be needed later. In particular, in the process of juvenile justice, correctional welfare workers intervene in the practice of professional knowledge and skills on correctional welfare, and the role of correctional welfare workers in the organization, education, and utilization of volunteers.
