성직자회에서 성직자 통치규정 개정의 적용과 의미: 교황 프란치스코의 제588조 제2항 개정(derogatio) 답서를 중심으로 (Application and meaning of the derogation of the norm of clerical Institution (Focused on Pope Francis' rescript to the abrogation of canon 588, paragraph 2))

초록

축성생활회 가운데 성직회들을 위시하여 많은 남자 회에서 총원장을 포함한 상급장상의 자격이 성직자여야 하는 제한을 규정하고 있다. 이는 교회법 제588조 제2항이 “성직자회는 성직자의 통치아래” 살아가는 회로 규정하고 있기 때문인데, 현재 이 조항은 현 교황 프란치스코의 2022년 2월 11일 답서를 통해 개정되었다.
이 하나의 조항 개정이 갖는 의미는 축성생활회 가운데 성직회에만 국한된 영향으로 그치는 것이 아니다. 이는 여성축성생활회를 포함한 평신도 축성생활회의 신원에 대한 고유한 가치를 새롭게 바라보도록 한다. 교황 답서에 의한 제588조 제2항 개정의 타당성을 논술하는 이 연구는 먼저 통치권에 관한 법체계의 문제를 연구하였다. 즉, 축성생활회의 장상의 권력이 교회 통치권에 속하는지에 관한 숙고와 교회 통치권에 속하는 회와 그렇지 않은 회가 갖는 제588조의 문제점을 연구하였다. 이어 본 답서의 내용과 그 적용을 다루면서 답서에 언급되지 않은 교구설립성직회의 고유법 폐지(개정) 문제를 일반규범에 비추어 두 가설을 제시하였다. 이후 축성생활회에 관한 발전된 신학의 기초 위에 축성생활 신분이 교계적 신분인 성직자와 평신도라는 이원론적 구분을 넘어서는 새로운 신분이라는 숙고에 기반을 둔 통치구조가 구성되어야 한다는 면을 논의하였다. 그리고 그 구성이 축성생활회의 은사적 특성, 형제적 (공동)생활 측면, 고유법의 고려 등에 따라 다양해야 한다는 관점에서 기존 제588조 제2항을 통한 성직자 중심의 축성생활회의 구조화는 축성생활회의 고유한 성격에 부합하지 않는다는 결론을 도출하였다. 마지막으로, 이 조항의 개정과 함께 형제적 (공동)생활, 은사의 삶, 고유법의 관점에서 자신의 회에 어울리는 고유한 통치구조를 축성생활회들이 새롭게 발견하여 적용하기를 바라는 기대를 본 연구에 담아 전망해 보았다.

영어초록

Among the Institutes of Consecrated Life, many men's institutes, including the Clerical Institute, stipulates the restriction that the qualifications for the major superior, including the general superior, must be a priest. This is because Article 588, paragraph 2 of the Canon Law stipulates that “the clerical Institute is under the rule of clerics”. This article was abrogated by the Pope Francis in a rescript on February 11, 2022. The meaning of the abrogation of this one article is not only limited to the clerical Institute among the Institutes of Consecrated Life. This allows us to take a fresh look at the inherent value of the identity of member of the non-clerical Consecrated Life Institutes, including female convents. This study, which discusses the validity of abrogating Article 588, paragraph 2 by this papal rescript, first investigated the problem of the legal system regarding the power of governance. In other words, It studied whether the power of the superiors of the Consecrated Life Institutes belongs to the church's power of governance and the problems of Article 588 between those belonging to the power of governance of the church and those not belonging to the power of governance of the church. Then, the contents of this rescript and its application were discussed. Two hypotheses were presented in light of the general norms, regarding the abrogation of the proper law of the diocesan clrerical Institutes, which was not mentioned in the rescript. Finally, on the basis of the developed theology of the Consecrated Life Institute, The aspect that the form of the government structure should be structured based on the consideration that the status of the Consecrated Life is a new status beyond the dualistic distinction of clergy and laity, which are hierarchical statuses was discussed. And from the viewpoint that its composition should be diverse according to the charismatic characteristics of the Consecrated Life Institute, the aspect of fraternal communal life, and consideration of the proper law, I came to the conclusion that the structuring of the Consecrated Life Institute through Article 588, paragraph 2 does not corresponds to the unique character of the Consecrated Life Institute. With the abrogation of this Article, this study was conducted to help the prospect of how the Institutes of the Consecrated Life give new meaning to the governance of the Institutes in terms of the fraternal communal life, the charismatic life, and the proper law, and how to apply it to their own Institutes.
