제4차 산업혁명시대 교양교육과 법학 (Liberal Arts Education and Law in the Era of the 4th Industrial Revolution)

초록

사회 전반에 걸쳐 변화와 혁신의 필요성을 말하고 있듯이 교육에서도 그 변화와 혁신에 관망자가 아닌 당사자의 지위에 있다. 기존의 교육방식에서 탈피하여 미래를 위한 준비과정으로 교육계에서도 여러 가지 방안들을 고민하고 시행한다. 이는 다시 말해 제4차 산업혁명에 맞는 인재상 정립과 육성, 교육역량 강화방안, 교사교육, 교과교육의 방향 등 근본적인 체계부터 세부적인 체계까지 검토하고 있다.
이러한 변화의 요구에 발맞추어 인문학과 과학기술의 만남 등 융합 교과과정을 탄생시키기도 한다. 그렇다면 법학교육은 어떻게 변화하고 준비해야 하는가라는 문제가 생긴다. 특히제4차 산업혁명시대 대학의 교양교과정에서 법학은 어떠한 자리매김을 해야 하고, 그 방향성을 어떻게 설정해야 하는지 진지하게 고민해야 할 시점이다.
법학은 전통이론적 측면과 더불어 실용적 학문의 성격도 가지고 있으며, 사회와 밀접한 관련성이 있다. 법은 그 시대상을 반영한다. 민주사회 시민이라면 지켜야 할 최소한의 규범을학습하고 실천하는 것이 곧 법학이다. 그러나 현재의 상황은 고등교육 전반에 변화가 있으며, 이에 맞추어 법학교육, 특히 민주적 시민 양성이라는 목표를 견지하고 미래사회를 위한 단초를 제공해야 할 것이다.
법은 한 국가의 모습을 나타내는 것으로 국가의 역사와 문화와 밀접하게 연결되어 있다. 법은 사회변화에 맞추어 같이 하고 있으며, 결코 사회제도도 법을 떠나서 논할 수 없다. 교양법학교육의 경우에도 제4차 산업혁명시대에서 요구하는 ‘협력적 창의 역량’을 함양할 수 있는 한 축을 담당하게 될 것이며, 다양한 학문분과와 그 경계를 허물고 협업을 통해 그 결과물을도출할 수 있을 것이다. 이를 위해 대학들은 단순 지식 전달이나, 시대적 조류에 편성한 융합교과를 개설하기 보다는 교양교육의 본질에 걸맞은 교과목을 설계하고 미래사회를 준비해야할 것이다.

영어초록

As the need for change and innovation in the whole society is being discussed, education is also the target of change and innovation rather than an observer. The educational circles are considering and executing different measures, too, in order to break away from the existing educational methods and prepare for the future. In other words, a fundamental system as well as a detailed system is being examined including the establishment of the model of talented men appropriate for the 4th industrial revolution and fostering them, the ways to strengthen educational capabilities, teacher training, the direction of curriculum education and so on.
To keep pace with this demand for change, convergence curriculum has been developed with humanities and scientific technology combined together. Then, the following problem arises; how legal education should change and prepare. In particular, now is the time to seriously think about how law should be established in the liberal arts classes of colleges in the era of the 4th industrial revolution and how its direction should be set.
Law has the nature of practical study as well as that of a traditional theory, and is closely related to the society. Law reflects the times. Law means that one learns and practices the minimum norms of a citizen of a democratic society. Yet, in the present situation, the overall higher education has been changed, so it needs to keep pace with it by sticking to the goals of legal education, especially the training of democratic citizens, and provide the motive for the future society. Law shows the aspects of a nation, and is closely related to the history and the culture of the nation.
Law follows social changes, and a social system can never be discussed without considering law. The legal education as liberal arts will also play a role to help develop ‘the competence of cooperative creativity’ demanded in the 4th industrial revolution, and yield results by breaking boundaries with diverse areas of study and by cooperating with them. For this, colleges must design curriculum which is proper for the nature of liberal arts and prepare for the future society, rather than open convergence curriculum for simple delivery of knowledge or to take advantage of the trend of the times.
