고려전기 노비정책과 禮制 정비 (A Study on the Noby Policy and the Readjustment of Decorum in the Early Days of Koryo Dynasty)

초록

이 논문은 고려전기 노비제 정비의 방향을 예제 실현이라는 측면에서 살펴보았다. 신분은 율령에 의하여 규정된 사회적 지위이므로 율령의 국가적 질서와 가족질서를 잘 반영하고 있다. 따라서 고려 전기 노비제 정비는 곧 율령의 국가적 질서와 가족질서[주노질서]의 실현인 것이다. 이를 국왕별로 알아보았다.
Ⅰ장에는 국가질서 정비 측면에서 태조와 광종의 노비정책을 알아보았다. 태조는 후삼국 통일 이전 이상적인 유교정치를 실현하기 어려운 국내외 상황으로 법가를 차용하였다. 이점은 태조 원년에 시행한 노비해방령에서 엿볼 수 있다. 즉 이 정책은 노비주인 호족의 노비소유권을 침해하는 것이었다. 다만 왕권이 정착되지 않았던 시점에서 노비주에게 일정정도의 대가를 지불하고 있다. 그러나 광종은 노비안검법의 시행에 노비주에 대한 일체의 배려도 없었다. 이로써 국가질서를 중심으로 하는 노비제 정비가 이루어졌던 것이다. Ⅱ장에는 가족질서인 주노질서 측면에서 성종의 노비정책을 알아보았다. 성종은 유교적인 정치질서를 지향하는 국왕이므로 노비주인 신하의 권한을 강화하였다. 이 시기는 신하를 예로 대우하면 자연 이들이 국왕에게 충성으로 보답한다는 유교적 예치가 정착되었기 때문이었다.

영어초록

This paper looked at the direction of the Noby policy of the in the early days of Koryo Dynasty in terms of the readjustment of decorum. Identity is the social status prescribed by the law. The advantage is that identity well reflects the national order and family order of the Yullyeong. Thus, the readjustment of the Noby policy is the realization of the national order and family order of the decree. This was recognized by the king.
In Chapter I, we recognized the noby policies of King Taejo and king Gwangjong in terms of the readjustment of national order. Taejo borrowed the law from both home and abroad, which was difficult to realize ideal Confucian politics before the unification of the late Three Kingdoms. The benefits can be seen in the Noby Liberation Ordinance, which was implemented in the first year of King Taejo. In other words, the policy was a violation of the Novi ownership of the Hojog. However, they are paying a certain amount of money to the noby owner at a time when the royal authority has not been established. However, King Gwangjong did not have any consideration for the noby owner in the implementation of the Novi Angeon law. This resulted in the readjustment of the Novi system, which was centered on the national order.
Chapter II recognized the noby policy in terms of the family order Juno order. As King Seongjong is a king who pursues a Confucian political order, he has strengthened the power of his noby olders.
