Semi-permanent makeup is a representative beauty field in Korea that is rapidly growing in response to the beauty needs of modern people, and 90% of the estimated 600,000 tattoo artists consist of semi-permanent makeup artists who are non-medical personnel. Despite the growing semi-permanent makeup industry and the need for legal regulations to protect consumers, the safety of the procedure is not guaranteed due to the lack of qualifications for semi-permanent makeup artists. This leads to unclear who is responsible for consumer anxiety and side effects that occur after the procedure, leading to a gap between the law and reality of semi-permanent makeup, which has become a cultural beauty trend. In addition, as consumers, operators, and the medical community are voicing the need to promote legalization by separating tattoos and semi-permanent makeup, consensus and cooperation measures are needed to solve the problem of semi-permanent makeup procedures by non-medical personnel.
Therefore, the purpose of this study is to analyze the necessity of semi-permanent makeup legislation to derive the necessity of semi-permanent makeup legislation and to propose realistic and effective legislation measures to seek cooperation measures.
In order to achieve the purpose of the study, we reviewed previous studies on recent trends and obstacles to legislation related to semi-permanent makeup, and devised a basic framework for a questionnaire to derive the necessity of legislation for semi-permanent makeup procedures. We conducted an online questionnaire targeting a total of 626 consumers, practitioners, and medical professionals. Based on the results of the questionnaire, we analyzed the general information of the research subjects, their awareness and experience of semi-permanent makeup, the safety of semi-permanent makeup procedures, and the frequency of the necessity of legislation for semi-permanent makeup procedures. We also performed One-way ANOVA and Scheffe analysis to identify differences in the necessity of legislation for semi-permanent makeup procedures by research subjects, and we confirmed the following results through a cross-analysis to identify the necessity of legislation for semi-permanent makeup procedures by occupation.
First, consumers selected the professionalism of the practitioner (52.9%) and safety of the procedure (29.1%) as the most important factors in semi-permanent makeup procedures, responding that the legal qualifications of semi-permanent makeup practitioners were an important factor (97%) and that legal regulations were necessary to ensure the safety of semi-permanent makeup procedures (90.7%). Second, regarding the need for legislation of semi-permanent makeup procedures, 91.9% of respondents agreed on the need for legislation, and 86.7% of them responded that legislation was urgent. In addition, they cited ensuring the safety of the procedure (30.5%), strengthening the qualifications of practitioners (23.4%), establishing a legal protection system for consumers (21.5%), and preventing side effects and accidents of the procedure (21.1%) as advantages of legislating semi-permanent makeup. Third, as a result of the difference verification by occupation, medical staff showed their opposition to legislation by evaluating the necessity of legalizing semi-permanent makeup procedures (3.98 points) and the urgency of legalizing them (3.95 points) lower than the averages of consumers and practitioners (4.49 points and 4.47 points, respectively).
The legalization of semi-permanent makeup treatment is an essential process for consumer protection and industrial development, and it is necessary to create a safe and reliable treatment environment by strengthening the professionalism of the operator through clear legal standards. In the future, it is suggested that empirical data analysis studies related to the effect of implementing the legislation of semi-permanent makeup will be followed to seek ways to develop semi-permanent makeup in the environment prescribed by law.
