초록

최근 들어 범죄율은 청소년에서 노년에 이르기까지 전 연령층을 망라하여 광범위하게 증가되고 있는 실정이다. 범죄율의 증가와 더불어 출소자들의 복역만기 후 사회적응의 어려움 또한 사회의 주요 문제로 부각되고 있다. 이는 출소자들의 재사회화의 실패가 범죄율의 증가와 악순환의 고리를 이루고 있는 데 기인한다. 이와 같은 문제는 한편으로는 우리 사회의 한 구성원으로서 출소자 개인의 재사회화에 있어서 심각한 고충에 대한 관심의 환기를 촉구하며, 다른 한편으로는 사회의 안전망 구축을 위하여 사후처방 이외에 보다 근본적인 문제 해결의 필요성을 제기한다. 이에 본 연구는 범죄율의 감소와 더불어 출소자들의 재사회화에 인문학적 접근이 교육적으로나 치료적으로 기여할 수 있는 지점을 모색해보고자 한다.
사회구성원들이 안전하게 살 수 있는 사회안전망 정비와 더불어 출소자들이 다시 사회 구성원으로서 편입할 수 있는 대책의 모색은 더불어 살아가는 행복한 사회를 만들어가는 데에 있어서 매우 필수적인 과제이다. 그러므로 이에 상응하는 다차원적인 시도들이 지속적으로 이루어져야 할 것이다.
본 연구는 출소자의 재사회화에 인문학적 접근이 기여할 수 있는 교육적이고 치료적인 역할을 살펴보고자 하는 필자들의 연구 계획의 전반부에 해당된다. 차기에 진행될 연구는 본 논문에서 다루게 될 이론적 연구를 바탕으로 구체적인 임상 과정과 결과를 집중적으로 다룰 것이다. 따라서 본 연구에서는 임상적인 부분은 본격적으로 다루지 않을 것임을 사전에 밝힌다.
이와 같은 계획 아래 본 연구는 출소자들의 성공적인 새 삶의 토대 형성을 위해 가장 필요한 재사회화를 인문학적 접근을 통하여 시도하고자 한다. 이를 위하여 우선 출소자 재사회화 사업의 현황과 재사회화의 요인들을 살펴본다. 다음으로 출소자 재사회화에 대한 인문학적 접근의 현황을 살펴보기 위하여 인문학 기반의 재소자와 출소자에 대한 인문학 프로그램 현황과 재사회화 인문치료 프로그램의 과제와 대안을 살펴본 후에 이에 대한 이론적 근거 정립을 위한 시도를 위하여 교육의 대상에서 주체로의 확장: 교육의 주체로서 ‘셀프’와 프락시스 관계로서 상호통섭: 상호 주체로의 확장의 가능성을 차례로 살펴볼 것이다. 그리하여 출소자의 재사회화에 인문학이 기여할 수 있는 지점을 상호통섭적 인문치료로 명시해 보고자 한다.

영어초록

Recently the crime rate tends to increase extensively covering all the age groups from youth to old age. The difficulties of released convicts' social adaptation after the expiry of service term as well as the increase of crime rate emerge as the main issue of the society. This springs from the fact that the released convicts' failure in resocialization forms the ring of a vicious circle with the increase of crime rate. Such an issue urges the attention to a serious difficulty in the resocialization of a released convict as a member of our society on the one hand, and raises the necessity of a more fundamental problem solution other than the post-recipe for the construction of social safety net on the other hand. This research hereby intends to group for the point where a human approach can contribute to released convicts' resocialization together with the reduction of crime rate educationally and therapeutically.
The organization of social safety net for social members to live safely and the plan of the measure for released convicts to be incorporated into social members again must be an extremely essential task in making a happy society living together. Therefore, multi-dimensional attempts corresponding to this shall be made continuously.
This research intends to study the educational and therapeutic role of a human approach to contribute to released convicts' resocialization, which comes under the first half of the writers's research plan. The research to proceed next will cover the concrete clinical process and result intensively based on the theoretical study to be handled in this thesis. Therefore, it is clarified in advance that this research will not handle the clinical part radically.
Under such a plan, this paper attempts to deal with the most essential resocialization of released convicts through a human approach for their formation of the foundation of a successful new life. For this purpose, first we will study the status of released convicts' resocialization project and the factors of resocialization. Next, in order to figure out the status of a human approach to released convicts' resocialization, we will study the status of a human program for humanities-based convicts and released convicts and the assignment and alternative plan of the resocialization Humanities Therapy program, and in order to attempt to establish a theoretical evidence thereto, we will study the extension of the object of education into the subject: the mutual consilience in the relation between 'Self' and 'Praxis' as the subject of education: the possibility of the extension as mutual subjects one by one. Therefore we will call such a humanities connected with released convicts' resocialization 'the Humanities Therapy of the Mutual Consilience'.
