초록

고령자의 기본권은 ‘노인’의 소외적․차별적 개념 하에 국가의 시혜적 영역의 한 부분으로 다뤄졌으며, 사회적 약자의 기본권 보장 체계에서 소극적으로 논의되어 온 것이 사실이다. 초고령사회를 목전에 두고 있는 현 상황에서 고령자의 기본권을 비주류 영역으로 치부하는 것은 지양되어야 한다. 국가는 고령자의 기본권의 보장과 이를 위한 법체계의 구성을 최우선의 아젠다로 선정하고 연령통합과 사회통합의 관점에서 적극적으로 논의하고 현재 지능정보사회와 고령사회 등 각종 사회현안의 문제를 해결하는 주류적 수단으로 고령자의 기본권을 논해야 할 것이다. 고령자의 기본권을 보장하는 법제를 구성함에 있어서도, 여타 문제를 해결하는 과정에서 부차적 또는 부수적으로 고령자의 문제를 접근하는 것이 아니라 고령자에 관한 이슈를 중심으로 여타 문제를 해결하는 방법이 도입되어야 할 것이다. 분산된 기본권 체계와 법제를 통해 혼재되어 있는 고령자의 기본권에 관한 문제를 통합적 체계에서 관리하고 조정할 수 있도록 법체계 전반의 개선이 필요하다고 본다. 현재 인간다운 생활권 보장을 위한 급부청구권의 분산, 주거권․보건권․근로권․교육권의 혼재된 보장체계 및 이로 인한 정책혼선과 충돌은 또 다른 법체계의 문제와 사회문제를 야기하고 있다. 결국 여러 분산된 고령자 법제 및 정책을 하나의 체계로 흡습하여 통합의 틀을 구성할 필요가 있다. 이 과정에서 여타 기본권 실현에 있어서 기초가 되는 법령정보접근권에 대한 명문의 보장도 필요하다. 지금까지 고령자 정책은일반 국민에 대한 일반 정책의 부수적 부분에 불과하여 이른바 소수자 정책이었지만, 이제는 주요한 정책으로 다수자 정책이 되어야 할 것이며, 이를 위해 하나의 법체계와 규범 틀, 나아가 이를 추진하기 위한 통일된 조직체계 역시 필요하다고 본다. 이러한 제반의 내용을 담아 ‘고령자기본법’의 제정을 제안하고자 한다. ‘고령자기본법’에는 고령자의 개념, 고령자정책의 추진체계, 전담추진기구, 고령자에게 인정되는 특별한 기본권의 내용(법령정보접근권, 연금등 급부청구권, 주거권, 보건권, 근로권, 교육권 등)과 기본권의 체계적 보장성 확보, 전달체계 구축, 고령자 기본권 침해시 권리구제 수단 등이 명시되어야 할 것이다.

It is true that the basic rights of the elderly have been dealt with as part of the state's granting area under the alienated and discriminatory concept of 'elderly', and have been passively discussed in the basic rights guarantee system of the socially underprivileged. In the current situation with a super-aged society at hand, it should be avoided to dismiss the basic rights of the elderly as a non-mainstream area. The state sets the guarantee of the basic rights of the elderly and the establishment of a legal system for this as the top priority agenda, actively discusses them from the perspective of age integration and social integration, and is currently a mainstream solution to solve various social issues such as the intelligent information society and the aging society. As a means, we will have to discuss the basic rights of the elderly. Even in establishing a legal system that guarantees the basic rights of the elderly, it is necessary to introduce a method of solving other problems centering on issues related to the elderly, rather than approaching the problems of the elderly incidentally or incidentally in the process of solving other problems. It is necessary to improve the overall legal system in order to manage and adjust the issues related to the basic rights of the elderly, which are mixed through the dispersed basic rights system and the legal system, in an integrated system. Currently, the dispersion of the right to claim for benefits to guarantee the right to live as a human being, the mixed guarantee system for the right to housing, health, work, and education, and the resulting policy confusion and conflict are causing other problems in the legal system and social problems. Ultimately, it is necessary to form a framework for integration by absorbing various dispersed laws and policies for the elderly into one system. In this process, it is also necessary to guarantee the right to access legal information, which is the basis for realizing other basic rights. Until now, the senior citizen policy was only a minor part of the general policy for the general public, so-called minority policy, but now it has to become a majority policy as a major policy. Organizational structure is also necessary. I would like to propose the enactment of the 'Basic Act on the Elderly' with all these contents. The 'Framework Act on the Elderly' includes the concept of the elderly, the promotion system for the elderly policies, a dedicated promotion body, the contents of the special basic rights recognized by the elderly (right to access statutory information, right to claim benefits such as pensions, housing rights, health rights, work rights, education rights, etc.) Securing security, establishing a delivery system, and means of remedy in case of violation of the basic rights of the elderly should be specified.
