스포츠스타의 일탈과 징계에 대한 일고찰 (Study on Legitimacy of Sports Star’s Deviance and Punishment)

초록

이 연구는 스포츠스타라는 이유로 일탈에 대해서 일반인보다 더 큰 도덕적 의무와 책임을 지녀야하는지를 존 롤즈의 정의론 입장에서 살펴보았다. 존 롤즈의 정의론 입장인 원초적 상황과 무지의 베일, 당사자들의 평등, 상호 무관심한 합리성 등의 개념이 포함된 공정한 정의 원칙을 적용하였다.‘원초적 상황’이라는 개념은 공정한 정의 원칙을 세우기 위해 사회 구성원들을 대표하는 계약 당사자들이 모여 협의하는 가상적 상황을 의미한다. 원초적 상황에 참가하는 사회 구성원들의 대표인 계약 당사자들은 스포츠스타들과 일반인들이라고 가정하고, 계약 당사자들은‘무지의 베일’원칙에 따른다. 무지의 원칙들이 스포츠스타들과 일반인들에게 적용되면서 무지의 베일로 차단되면 이전의 영광, 메달, 이미지, 업적, 탁월한 운동능력, 재산, 성향 등 모든 것들이 배제된 상태가 된다. 이 같은 설정은 계약 당사자들인 스포츠스타들과 일반인은 정의 원칙을 산출하는 과정에서 동등한 권리를 가지게 한다. 그리고 이들은 모두가 다 합리적 존재로서 어떤 목표를 추구하고, 존중받고 싶어 하고, 자신에게 이득이 되는 합리적인 선택을 한다. 이는 만약 자기 자신이 스포츠스타에 속한다면, 일탈로 인하여 선수생명의 위험을 가져올 처벌과 일반인보다 더 큰 도덕적 의무와 책임을 떠안고 싶지 않을 것이다. 무지의 베일이 걷히고 실제 삶이 시작되었을 때, 그들은 부당하다고 느낄만한 처벌과 대중들의 과도한 비판을 받는 상황을 원치 않는다. 이러한 위험을 막기 위해 스포츠스타들에게 일반인들보다 더 큰 도덕적 의무와 책임을 지는 것을 거부하고, 모든 시민이 사회적 법적 개인적으로 자유를 포함한 기본권을 평등하게 누려야 한다는 원칙에 동의할 것이다.

영어초록

This study examined if sports stars should take bigger ethical duty and responsibility for deviance from John Rawls’s theory of justice. This study applied the position of John Rawls’s theory of justice, the fair principle of justice, including the original situation and the veil of ignorance, the concepts of equality among the persons interested and mutually indifferent rationality. The concept of ‘instinctive situation’refers to a virtual situation in which contract parties who represent members of society gather and discuss in order to establish the principle of fair justice. The contract parties, the representatives of the members of society, who participate in the original situation are presumed to be sports stars and ordinary people, and the contract parties follow the principle of‘veil of ignorance.’As the principle of ignorance applies to sports stars and ordinary people, they are blocked by the veil of ignorance, and then the situation becomes one in which everything is excluded, such as previous glory, medals, images, achievements, excellent athletic ability, property, and inclination. This setting allows the contract parties, sports stars and ordinary people to have equal rights in the process of estimating the principle of justice. Also, all of them are rational beings, who pursue a goal, want to be respected, and make a rational choice that is beneficial for themselves. If they come under sports stars, they would not like to take punishment which brings about a risk to their life as athletes and bigger ethical duty and responsibility due to deviance. They do not want punishment they may feel unreasonable and a situation in which they receive unreasonable criticism from the public when the veil of ignorance lifts and the real life begins. In order to avoid this risk, the principle that sports stars should refuse to take bigger ethical duty and responsibility than ordinary people do and that all citizens should enjoy equally fundamental rights including freedom, socially, legally and personally.
